  • Hi everyone hope you can help or offer some advise. Have been on a dmp since June 2012, and all but one of my creditors Nationwide have accepted my plan, and I do really feel for the first time in years we are really making progress reducing our debt :) Nationwide however decided that unless we paid an additional £10 per month they would go for a charging order. I have written to them explaining that I cannot treat any of my creditors differently, but they are saying they need the debt to be paid in 60 months, and as ours is currently 64 months they have no option than to go down the charging order route. Any advise or should I just let them do what they are going to do? Thank you hope you can help?

    Hi there,

    We were in a similar position when we were at the height of our recession/low income days. We pay Stepchange by Standing Order, and provided they receive the payment before the 14th if the month i believe it counts as a payment for that month. Our SO is set up for the 1st, but i f we need to move it a few days we can easily do this online. Its worth looking into and double checking with Stepchange the latest date they can receive payment.
    DMP total Mar 2009 = 43,836
    DMP total now = [STRIKE]35,883[/STRIKE] 33,500
    Debt free date = [STRIKE]2044[/STRIKE] 2037
    Debt free aim = 2025

    Are they charging you interest? If so Id let them take you to court. The judge may apply a charging order (just to stop you running off if you sell your house) but he will also likely stop interest plus or minus refund of it.


    You could is possible find the extra tenner and pay them yourself ontop of the DMP provider


    Or you could launch a complaint which FOS may or may not uphold. Makes you feel better for not just rolling over!

    Thanks for the prompt reply. No they are not charging interest, and I did find the extra £10 for a while but they then informed my dmp who were not happy, and said if we continue they would cancel a plan. So I decided to write to NW and that's what they have comeback with. I will perhaps complain to FSA and see where that get's me. But the other half of me just feels like you know what NW bring it on :) Thanks again

    .......I think DM and AP markers are incredibly unfair as they damage your credit rating more than a default. Some people have had success fighting them and have managed to get the defaults back dated. It may be worth giving it a go.

    Sorry for jumping on your reply TTFTM, but I'm sure I've seen something on the DFW forum (I think Fermi posted it up?) which provided a link to a website about this very issue. Again, I'm sure I read that there is a certain regulation about having to default debtors after 6 months of lower than contractual repayments. But don't quote me. I'm having this issue with Hfx and am giving them the next two months to default me, they've only applied three DM markers to my account so far even though I've been in the DMP since June 2013, otherwise I'm taking my complaint back to the FOS!

    There has recently been a thread on the dfw board with some success getting b.card to change ap's to defaults. I shall certainly give it a go in a few months time.

    So I thought things were rolling along but I got a text yesterday to say step change haven't received anything from me :( I've scanned documents at work, sent them home and now forwarded it all to step change via email. For once I'm thankful for photocopying everything!

    Really wasn't my day yesterday, child benefit payment wasn't issued so I'm waiting for that too (they said 2-3 days) and despite HSBC saying my accounts are on hold came back to a wad of letters from them :(

    Thank goodness I have this forum or I'd be in a terrible state! This time next week my surgery will be over so I'm desperately hoping everything can be set up quickly.

    I can't seem to get a final figure on my debts, I've sent SC all the account numbers with a covering note to say I'll send in balances ASAP. Will they be able to get these from creditors or can I just send in what I can find out? All but one account now has a partial payment outstanding so some are adding late payment fees (hence no clear balance figure). I'm really not sure what I need to do and can't get through to SC on the phone.

    I really want to get this sorted ASAP so I can concentrate on my recovery then in a couple of months upping my income. Got myself into a right stress over this :(

    Hi Kate, sorry for your troubles today. Don't worry about exact balances, sc will get them from your creditors. Unfortunately they will also go up before they go down, but that is normal.
    Good luck with the surgery, hope your all better quickly.
    And don't worry about all this stuff...it will all get sorted.

    Thanks Puzz, I think it was you that warned me about that happening a couple of weeks ago so I wasn't too upset to see it but it's still not nice.

    My day is looking up, DH noticed I needed a bit of support (he's been working away today - left him at train station before 7am!) and once I'd fed kids and picked him up he's taken charge. I've had a lovely dinner cooked from scratch and he's now doing bedtime stories while I put my feet up as instructed.

    Hopefully the ball is rolling now. It's not like my problems are huge, I've just let them get to me today. Thank you for putting my mind at rest. I'll certainly sleep a bit easier tonight.
