HELP! want to take my complaint to FOS but 3months past deadline!

hi everyone, it's my first post on the site. i made a complaint about hsbc last year, but now realised that it's been nearly 10months since i got the final response from hsbc. can i still take it to FOS? If so how can i explain why i missed the 6months deadline? what can i do? please help! any advise welcome

    The FOS are very stringent on the 6 month deadline. Typically they only consider incapacitation or bereavement of direct family member as good enough reasons.
    If so how can i explain why i missed the 6months deadline?

    You would have to show why are you were incapacitated for the whole 10 month period.

    What was the basis of your complaint, and what was the final response you got back from the bank? i.e. why did they feel it correct not to uphold your complaint.
  • i wrote to HSBC and stated the charges were not fair and they rejected it. the final response they gave me stated clearly that they thought it was fare even though £25 per charge for going over my overdraft was fair. so there, that's that, they think charging me nearly £500 for going over my overdraft and charging on top of the charges are fair therefore rejected my bank charges complaint without wanting to give back a penny. please advise. thanks.

    i wrote to HSBC and stated the charges were not fair and they rejected it.

    Which was always going to be the response. It is the one thing you should not do when making your complaint. Its an auto-rejection.

    The banks won the court case. You are many years too late to go down the unfair charges route. Even the FOS wont take on complaints about unfair bank charges any more.

    Banks will consider refunds where you meet their financial hardship criteria, if its your first time mistake or are just feeling some goodwill towards you. They will not refund to people claiming charges are unfair.
