Can I request a replacement?

Hello!

On Christmas Eve 2012, I bought a tablet PC from Tesco at the sale price of £50.

It's faulty and I have a reference number from their technical team to confirm this - along with date etc I contacted them to report the fault.

However, the price of the tablet has since gone back up to its normal price of £100, and has been out of stock until now.

As this was a gift for my Mother, I'd like the faulty tablet replaced, rather than having a refund.

Am I within my rights to request a replacement, rather than a refund? When I contacted Tesco by phone, they said I had to have a refund due to the increase in price. Are they right?

Obviously, I have the receipt as proof of purchase and I bought it on my credit card.

Many thanks for any advice you can give me. I've looked online and it's a little confusing as to whether the choice is mine or Tesco's.

    The retailer has the right to repair, replace or refund whichever is the most cost effective for them.
  • Thanks, molerat. Given the price increase since I bought the tablet, I'm guessing they're going to stick to giving me a refund...

    Annoying, since had the price decreased in the interim, I'm sure they'd have insisted on a replacement.

    I appreciate your help.

    Is this the Archos by chance? DD bought one herself on boxing day. Can I ask what the fault is?
  • A refund can have "fair use" deducted from it so it may be a cash settlement you get but it could be lower than the purchase price

    Entirely correct, but as it has been less than 2 months, then I would not expect any deductions at all in this case.

    Agreed, I got my years mixed up :(
