Mis-sold bank package

Hi, I'm a new member. My husband has an Additions Plus current account on which he has been paying a mothly premium, currently £6.00 per month. The premiums give insurance cover for a mobile phone, car breakdown recovery and travel insurance. I contacted Barclays Customer Services on 27 January and raised a complaint which I then followed up with a letter sent recorded delivery. I contacted Barclays this morning and they were unable to trace a record of the complaint or receipt of the letter. I explained to the Supervisor that my husband felt that he had been mis-sold the bank package account. The insurance cover was worthless as he does not have and has never had a mobile phone. He has a medical condition and ordinary medical insurance would not cover him for the condition. Also, the breakdown recovery is covered by his car insurance. Nothing was explained to him properly and he was of the opinion that what was on offer was free. We received a call from Barclays to say that they had sent out a number of packages to him over the years and there were cool off periods, so they did not think that the package had been mis-sold. They offered as a good will gesture to reimburse the premiums for the last 12 months. Does anyone know if he has a strong enough case to refer the complaint to the Financial Ombudsman. He has a number of large credit card debts, so any cash he could get back would be a big help.

    This could have been cancelled at any time - why was it kept running if it was not wanted?

  • I agree but he is very careless about financial matters. I just wondered if there is any point in pursuing this, the insurance cover is worthless

    Up to you, but I would consider the 12 months offer pretty generous.

    His carelessness doesnt mean it was miss sold.

    I would grab the 'goodwill' gesture with both hands to be honest
    make the most of it, we are only here for the weekend.

    Take the offer and think yourself lucky. If he can't be bothered to check his statements then hes obviously got more money than sense.
    It would have been in the T&Cs that he signed, in the policy booklets/blurb that he would have received so there is no excuse for not knowing.

    This does not sound mis-sold.

    What evidence do you have to support a mis-sale?

  • He required an overdraft facility and was told that he needed a package account.
  • Firstly, if you complained on 27 January Barclays had to resolve it to your satisfaction by the end of the next working day (although 27 January was a Sunday - so strictly it would be deemed received on 28 January).

    If you go to the Ombudsman, the question will be whether it was presented in a way that was clear, fair and not misleading.

    However, they have eight weeks from when your original complaint was received to respond.

    As it was sent RD, find out when it was delivered. That is the point at which you can prove the eight weeks starts running.
