I cant believe someone would take on an internet course without even having the internet in the first place, but thats not the point.

The problem the op has is that he was given the opportunity to take the course 5 years ago and didn't do it, the contract is concluded on that matter alone, he was never refused access to the course so had the chance.
The fact they are now bust gives a glimmer of hope, but leaving it 5 years to claim is pushing it a bit, I believe the ombudsman will side with Barclays on this one due to the fact you have been paying for 5 years, so accepting the debt.

ok, so when your 18 yr old girl and youve never done anything like this in your life, your scared their threatening bailiffs and court ringing the house all hours aswell. the easiest option was to pay. i wasnt sleeping i couldnt eat i was a wreck. if i cancel the payments they threaten me again. what choice do i have but to pay?
on the internet thing, when i signed up i presumed my mam would allow me to get the internet installed to help me, but when she found out how much it was she went mad and refused point blank.
i paid the debt cz i didnt have a choice!

I'm not judging you so please don't think I am, just pointing out that 5 years down the line may be a bit late in trying to get a refund. You had the chance to do the course but didn't do it. It will all hinge on the ombudsman deciding whether or not the course was available to do or not, and to who was to blame for it not getting done.

You can't blame your mum either, you didn't have the internet and you didn't discus it with her first.

No 1 is judging you OP, its now 5 years or over 5 that it happened, you left it too long to do anything about it.

OP you did have a choice, you could have cancelled before the 14 days were up. When your mum told you no that you couldnt do it you should have been on the case to get it cancelled and not forget about it.
  • Having the Internet is something you'd normally do before signing up to a web-related course, surely?

Or have it planned to be installed before you start the course.
  • its not that i didn't cancel it...by ringing the salesman within 2-3 days of signing up, i put my trust in him that he would cancel it as he said ill sort it all don't worry. i said do i need to do anything and he said no. i left it at that. i heard nothing else until barclays partner finance sent me a letter saying they were taking money out of my account.
by the time that happened the 14 day period was up and i've had no choice but to pay after being threatened.
yes i was very naive for not looking at the credit agreement. but hey i was a kid. paying all this time has kept them off my back.
there was also no time scale on the course.
as the company were dissolved in 2010 i should have been offered alternative training solutions by another company. they were the words from trading standards as id only started paying the course properly Jan 08' that would have only given me a time frame of 2 years to complete the degree if i had indeed done it? and as the it course company have failed to keep up their part of the deal, barclays are jointly responsible for making sure i get the alternative course arrangements. i had already asked my mam to get the internet installed before i signed up for the course which she agreed to. but when she found out how much the course was and what id signed up to. she point blank refused to get it installed on the grounds of paying that much for the course and the internet connection would be ridiculous.

i must say some people have been very helpful to me on here pointing me in directions that could indeed help my case, and some are just being rude and ignorant. i was advised to come on here to get good helpful friendly advice. there is no need to take the mick out of me and be so rude. thanks to the people who have given me good advice, but i wont be ever coming on here ever again.

    "Hi rwillis88

I work for Gregory Pennington. I'm sorry to hear of the problems you are having.

As part of your Debt Management Plan you have access to our Financial Speclialists team (at no extra cost) whose job is to deal with legal issues and priority (and secured) debts. Reading your post it looks like it would make sense for the Financial Specialists to have a look at the validity of the agreement and whether you are liable for that debt.

If you would like us to look into this further for you please drop me an email to sarah.jolly@gregorypennington.co.uk or advise your PFM that we have been in touch and the best time for us to call you.

    I hope this helps."
