LHA question

can one of you kind folk out here answer a question for me I will try to keep it brief.
A tenant of mine has been in a 3 bedroom house for 6 years or more initialy with his wife and children .
His children moved out a number of years ago and sadly his wife became ill and died before christmas .
He had/has a small job but still was able to claim LHA which is paid directly to us with him making up the shortfall ( I asume he was recieving carer allowance also) .
The council have asked him for a new tenancy agg. which we are happy to give him however by giving him a new aggreement and the change of circumstance would they then be entitled to pay only a single person rate ? Or will this now be automatic reduction

Well, it sounds as though he is a single occupier, what is the problem?This is an open forum, anyone can post and I just did !0

As his children moved out, his LHA would have shrunk, and then after his wife died, he would have been moved to the 1 bedroom rate of LHA so long as he notified the local council of his changes of circumstances as he is obliged to do (otherwise it is fraud), though I suspect it would naturally have taken him some time to get all his affairs in order.
It is then up to the tenant to make up the shortfall between his rent and LHA out of his income. What is this shortfall between the 1 bed LHA rate and the rent you charge? What benefit is he now on or is he still in employment?0 -
I suspected it would be a standard reduction and yes he did tell them of a change , I get loads like this all the time but have never been asked for a new tenancy aggreement by a local authority.Maybe I am reading too much into this .
Infact today we have given the council a letter confirming his periodic tenancy still stands .

Our council periodically ask us to get our LL to send a letter confirming rent charged. I think it is just to prevent fraud.0

If he is aged over 35 (which I am assuming he is) he will only be entitled to the one bedroomed LHA rate for your area. It will be based on his income so if he has a small job he may not get the full amount of the one bedroomed rate.
Although all rates are now frozen and linked to the Consumer price index not the Broad Market Rental.The most wasted day is one in which we have not laughed.0 -
