Employers P11D Mistakes

I am retired but still receive Medical Insurance cover from my ex-employer that's declared by them annually to HMRC on a P11D. In addition, prior to the start of a new tax year, my ex-employer tells me the cost of the insurance for the next 12 months and I notify HMRC accordingly. However for the last 3 years the amount submitted by them on the P11D differs from the amount they told me it was going to be, causing HMRC to issue revised tax codes. On querying the new codes, HMRC say P11D submissions always override mine.
Following long correspondence with my ex-employer they have recently apologized, acknowledged their errors and stated that they were made by someone who no longer worked for them.
I realize that I am responsible for my own tax liabilities, but I will now be faced with a £600 tax bill through no fault of my own.
Does my ex-employer have any liability?

  • Your employer should submit revised P11d to HMRC. Get them to confirm what they have now told you in writing. hMRc can then revise your calculations

  • Thanks for the reply, but does my ex-employer have any liability beyond correcting their errors that are now 5 years old and from which I will incur a largish retrospective tax bill. In other words, do I have any grounds for pressing them for an ex-gratia payment?

    Has your employer revised the P11D's for earlier years or are they saying that the figures they provided you with at the start of each tax year were incorrect? I am not clear exactly what their error was.

    So is it the last 3 years or the last 5 years ?

    Am I correct in thinking that the ex-employer told you an incorrect figure and are now submitting P11d to hmrc with a correct larger figure ? Can you be more specific as to what has happened and which years it involves and the amounts ? Also whether you complete self assessment tax returns?

    If you are PAYE only (and not self assessment) there are tolerances each year and if the amount you owe is below the tolerance then HMRC will not collect the amount due if a P800 Tax Calculation has not already been issued for any other reason
