PCN for parking adjacent to a verge lowered to meet level of carriage way

In full it reads

Parked in a special enforcement area adjacent to a footway, cycle track or verge lowered to meet the level of the carriageway.

Today I had to drop some bits off at the office. It's quite a long section of drop kerb alongside a pathway that runs parallell to a residential property. At the bottom of the property it has, what looks like 2 garages but they are doorways. Fair enough, they do say no parking on the doors but I did leave space for a car to get out from the end on.

What's really annoyed me is the car behind me which was also parked on the same drop kerb, didn't get ticket.

Is there anyway to appeal this ticket? It's £55 for 14 days and double thereafter. I'm not afraid taking this to court if there is solid evidence to support my appeal. For instance I wouldn't park across somebodies drive but these are doorways through fencing so no vehicle access has been blocked.

Thanks in advance.

It sounds like a council PCN can you confirm it is. Thanks

Technically and according to law, you have parked adjacent to a dropped kerb which carries a penalty. And by your admission, you committed that offence.

In a way, it's a bit like being caught doing 80mph on a deserted motorway at 3.00 a.m. You weren't causing anyone any inconvenience, you only did it for a mile for some reason etc.

So, if you acknowledge committing an offence, then it's down to finding mitigation to see if you can get off. Pictures of signs, the area, where you were parked etc etc would be needed and then it's a matter of persuading a court why you need to be let off.

All this presumes, of course, that this is from a genuine traffic warden or similar employed by the council and that you haven't been scammed by a PPC warden.

Yes it's a genuine PCN. I have taken photos just in case, it's a random long dropped kerb.

If I have to pay then fair enough but it has annoyed me that they ticketed my car but not the one behind me that was parked exactly the same as mine.

    Thanks for your input

If this is a council ticket he's admitted here that he's parked there, so has not acknowledged them at all so still has options that are not just mitigating circumstances. For example the signs or markings may not be compliant, the PCN is incorrect, the TRO could be wrong or other issues.

Appeal it anyway, even if you use 'the other car not getting a ticket' (enclose copy of pic) line. At this stage you have nothing to loose.

I would but this council are well known for being OTT on parking tickets, giving them out when cars are parked legally and rejecting the appeals.

I know I need concrete evidence if I stand a chance otherwise I might as well pay and get it out of the way.

Thank you everyone for your input, I really appreciate you coming back to me so quickly. I have on the pepipoo website now.

Most councils reject informal appeals , but most people who take advice and follow it from pepipoo win .
