How many cheques have you sent so far? If it was (example) 4 cheques then that is £200. So you still have that £200 available, unspent?

Were you a business or a company purchaser or just a private transaction.

This was a private purchase invoiced to me, but from a company I buy from as a business as well if you understand, they invoiced me not the company.

Is there money in your account / overdraft to cover all the cheques that you have sent so far?
How many cheques have you sent so far?
    Are you still sending them?

Hi four cheques now sent but I was hoping the small managable chunks would come out each week so I could cope, each time I go into the overdraft the money it topped back up each time I get some cash in.

I would just keep the £50 a week to one side, then if there is no court date within 10 weeks you can pay them the amount in full, and if there is a court date, you can say to the judge "I offered £50 a week which they refused. Here it is so far". They judge would really not look kindly on them for wasting his time
One important thing to remember is that when you get to the end of this sentence, you'll realise it's just my sig.

The account you had with them ?
How is this formed, is it a business account, did you tell them you are a business or did you say you are just a member of the public.
    This could be quite important.
As they have allowed you credit on the goods, if you are a private individual and the account is as a private individual not connected with any business then they would need a credit licence to sell goods in lieu of payment later.
If they dont have one, they might be stuffed.
    Be happy...;)

four cheques so far my over draft is £200 so yes they will be covered but this next one if they put them all in at the same time might not be covered depending on the day they cash them, that is why I wanted them to do it weekly, I did not check if they had cashed the first few until the court letter had arrived, I just expected them to see that I was going to and attempting to pay them.

Why have they been "underhand". Maybe they don't want a set of postdated cheques (of which there's no guarantee that they'll be honoured) and would rather have the full payment as owed

Where does it say the cheques were post-dated?

wow thats a good one, thanks, I do purchase from them for my business, but this purchase was a cash sale invoice directly to me as a private individual.
