TRying to clasim for PPI but bank says they don't hold the records any more!

Hi Folks

I took out a mortgage in 1998 from Bradford & Bingley building society (now known as Santander). I paid it all off about 10 years ago, and a few weeks ago I wrote to Santander requesting a copy of the mortgage agreement and T's & c's. They replied back saying that are only legally obliged to hold records for 6 years, so therefore they cannot provide any paperwork.

Does that mean I cannot pursue this any further or is there another route?

    It doenst. However, why were you asking for the mortgage agreement? MPPI doesnt appear on it. So, even if they could supply it, it wouldnt tell you anything.

    What are your reasons for complaint (noting that MPPI has the lowest uphold rate on any type of PPI)?

    The reason why I want to se the paper work is to work out if I was sold any PPI.

    It wont appear in the paperwork. So, that wont help you.

    One of the reasons MPPI has lower levels of complaints and upholds is that it is standalone plan. It is usually a direct debit from your current account on a monthly basis. Have you checked your bank statements.

    However, even if you are paying, that is not grounds for complaint. What would be your reasons for complaint? Also, I am not sure Santander would have the liability on these. A lot of B&B liability went to the FSCS and they wont consider pre-2005 sales. That also assumes B&B sold it in the first place and it wasnt a mortgage adviser/broker.

    A lot of loan PPI is front loaded with the premium added to the loan and charged interest on. That doesnt happen with MPPI. The vast majority are effectively pay as you go with a monthly premium from your current account. Single premium PPI is on the main complaint reasons with PPI.

    I said that just paying the premiums is not grounds for complaint. There needs to be reasons for complaining. Having MPPI is not a complaint reason.

    You haven't said what it was you paying, how it was sold, who sold it to you, and when it was.

  • I am I the same sort of boat! I took a mortgage and a home improvement loan with them, as I was a single mother,I had to take out the insurance, I have just written to Stantander, the said I had to pay £10 for them to look into in to it. I sent the money, they have written back saying they have located an MBNA account for me, I have to write to Bradford and Bingley! and pay another £10 what is all this about! sorry not very clued up on this Thanks
