Bailiff charges - Help needed

To cut it short - got into arrears at the begiining of the year - past to the bailiffs.

Never received any paper work through the door, the only time I saw anyone was on the third visit and the gentleman did not mention ever having been before.

All arrears and charges paid, but I am positive that they are spurious.

sent this in a letter to them 27th March

1st Visit £22.50 - date, time, full name of attendee
2nd Visit £16.50 - date, time, full name of attendee
Van fee £90.00 - date, time, full name of attendee and van registration.
Levy fee £45.30 - date, time, full name of attendee, full details of goods levied.
Debit card charge £20.89 – Confirmation from your bank that debit card fees are charged at percentage rate.


Received this back - letter dated 1 March!!!!!!

Council Debt: £772.00
Visit Fee 1: £22.50 (17.01.07 @ 18.00h)There would have been somehere it was a school night
Visit Fee 2: £16.50 (22.01.07 @ 16.00h)Same as above
Levy Fee: £45.30 (07.02.07 @ 11.15h)I work from home -
Bailiff Attendance: £90.00 (10.03.07 10.47am)First weekend in a month my girls were at their dads, was with my husband IYKWIM!!
Debit Card Fee: £20.89No bank charge a percentage fee on debit cards
Total Debt: 967.19
Paid: £967.19
Remainder Balance: £0.00

We would advise the bailiff who has been dealing with this file is Mr B** S****. We would also make you aware the bailiff also attended your property on 24th February 2007 at 9.50am but you have not been charged in connection with this visit.

The bailiff spoke to you on the 24th February 2007 as you claimed you had spoken to Nyra at the Council as you believed this had been paid directly to the Council via Standing Order. We liaised with our client the same day and they confirmed no standing order was in place as the payments sent in December and January had been returned by your bank. Therefore we continued to enforce debt as per our client’s instruction.



I only got this reply as I told the council I had not received a reply - where do I go from here.

    Re the fees do you have anyone or anything that can vouch for you being in when they called? I think even if they knock (allbeit quietly) and don't get an answer they can still charge you for the priviledge...

  • For the Levy charge and the van day - I have found that I posted at those times on another website, one day I was definatley in as my daughter was home ill from school - I have three dogs so if someone had knocked they would definately have barked!!!!

    I am checking back on the other dates.

    What is on the levy? (if you don't mind me asking)
    Surely, they would have had to have access you your house to make a clear list of goods - unless of course they have levied on a vehicle outside the property?

    My posts seem to be disappearing, did reply but it seems to hav dispearred - we dont know what they levied, they did not leave a note nor in my request tell me what they levied, if they did levy any of the cars - they belong to my husband who is not liable for the debt as I have the sole liablity for it, and would far out weigh the debt as we had reduced it by £250 at the time.

    You did speak to the guy on 7.2.07?

    If they say he did a levy, surely thay can provide a copy of the documentation?

    No I spoke to the guy on the 24th - and said I had not had any communications from them and that I was awaiting a letter, if he was the same guy he would have known that there had been a levy done, there is NO documentation for any of the visits.

    Can I suggest that you write to the Council and tell them exectly what has happened.

    I know that other posters have identified in accurate charges.

    The council - have been helpful they got the to finally reply - to my letter - there are deep inaccuracies.

  • Wahooo - fantastic bit of exciting news - have received a copy of what they say they levied on the 7/02/07 - a car that was in our garden - a white BMW that did not even belong to us and we sent to the scrap yard on the 29/01/07!!!!!! Have all the paper work - bring it on - this will be very very interesting!!
