Accident and claiming

I was in an accident on Good Friday on the M6, it involved 3 cars and i was the last car involved, I hit the car infront of me after she had hit the car infront of her and had come to a stop. Would i be entitled to claim anything? My car is a write off and I am due to receive the payment for this from my insurance, i was just wondering if i could claim for injuries i sustained?

Hi - to be able to claim for injuries you do need to be able to blame someone else for the accident. As you say you hit the back of the car in front I can't see how you can claim against anyone else and perhaps this is what you were half expecting to hear.0

I'm a PI solicitor. You almost certainly can't claim for your injuries because all drivers have a duty in law to keep a safe distance from the car in front so they avoid rear end shunts even if the car in front breaks sharply. If you had a passenger they could claim for their injuries from your insurers however.
Sorry i can't be more hopeful!0 -
I agree with both previous posters! If you look at the Highway Code you will see that you supposed to leave enough room so that you can safely stop!
The Highway Code also quotes the two second rule and says that the safe distance in the wet is double that of the dry (so that is four seconds). It also says that in icy conditions stopping distances can be 10x more! So, on that basis, that is 20 seconds!0 -
I was expecting such, I suppose i wasnt 2 second gap away but the cars were not travelling at high speeds and the car infront broke sharply and came to a stop because of her hitting the car infront of her, i was just wondering if there would be any claim due to her stopping on the outside lane of the motorway. thanks for the replies, and yes there were passengers who will be claiming.0
