in Credit cards
Hi all,
12 days ago I paid for fuel on my debit card. Provisionally the charge was pending on my account to be debited.
12 days later and the charge has disappeared from my pending transactions and the money hasn't been taken.
I have phoned my bank and they told me "you are in luck Mr *****, the retailer had failed to claim the money"
Is this really the case, am I £98 up or should I be cautious of the advice that I can now spend this money? I know I owe the money but I am not about to visit the retailer to point out their mistake for the fear that they will debit me twice.
Any advice from sombody with a similar story or has dealt with this senario before would be great!
Regards

I believe that they have up to 6 years to claim the money.....unless am wrong!0

Best hold onto it as l believe they can claim the money upto a number of years.0

Seems desperate that I will have to maintain a £98 buffer in my account for 6 years0

It'll be a bit more desperate if you don't have a spare £98 over the next 6 years. Are things that tight?0

They can still debit it from your account for 6 months.
After that time they are supposed to notify you to collect payment. Considering its a fuel station, they'll most likely already have your details via ANPR, so will just send you a letter saying "You owe us £98 for fuel purchased at X station on date at time. You have 14/28 days to settle this debt."
I had a very similar letter from Tesco when their machine refused to accept my card - they asked if I had an alternative method of payment and when I said "No", they said "No problem sir, we'll put a letter in the post, bring it back with your payment.".0 -

NO.......
You must have got the muppet :rotfl:
They can take this payment at any point in the next 6 months without any further contact.
Even after the 6 months they can still debit. But that can leave a chargeback option, depending on how they date the debit.Never ASSUME anything its makes a>>> A55 of U & ME <<<0 -
I'm curious about the law on this one too.
I ordered something and it has arrived. I have rung twice now to be told I was debited on the day off transaction. My bank account says not and nothing pending.
I'm stumped on what to do now
This is now over a month ago.Don’t put it down - put it away!

The law is simple: They have 6 years to claim (and you will be fully responsible for the debt), but if its longer than 6 months after the transaction, they should contact you about it first.
But my point is they have twice told me they have took it.Don’t put it down - put it away!

Well they could have keyed in the wrong details. So when someone else reports this as not their debit and gets bounced back. The retailer will run more checks and realise a error.
Maybe there was a issue with the payment processing on the day the transaction was made and as far as the yare aware it went through, but when a auidtor checks. They pick up the error.
Either of the above cases could/will see you debited in the future. Just make sure you have funds to cover the transaction.Never ASSUME anything its makes a>>> A55 of U & ME <<<0
