Car Insurance wont pay out

My car has been stolen and the insurance are saying they wont pay out because when we bought the car it was only sold with one key, and they are giving this as their reason.
On top of that on they are still taking out their monthly direct debit.

They will continue to take out the dd until you cancel the policy, or it lapses.
  • Was the vehicle recovered? If it was, was there signs of force being used to take the vehicle or not?

Did you buy it from a dealer and if so will they confirm they sold it with only one key?

Almost certainly, you haven't bought a monthly insurance policy. You have bought an annual policy which still needs to be paid for in full, even if the car is stolen or written off. The monthly payment is simply repaying a loan which you took out to pay buy the annual policy. If you look at the paperwork it should explain that.

If you had paid in full for the policy you wouldn't expect a refund if the car was a write-off after a month. You might be given credit against a policy for a new car but you wouldn't get a refund. The same applies even if you borrow money to buy the annual policy.

If you want month-to-month insurance, it is possible to buy policies like that.

The claim is a separate issue, which others will be able to help with.

How do they know it was only sold with one key?

I've bought loads of cars with only one key. If I want another I just pop into a high street key-cutter and get another one cut.

I presume they asked for the key and he only sent one. Or told them he only had one key.
Censorship Reigns Supreme in Troll City...

  • Have you given them the key that you presumably still had after the car was stolen, or is it more the fact that you cannot provide a key? There could be numerous avenues they are using, so without specifics of the actual detailed reason for the declinature of claim hard to advise, but one key is an insufficient reason to turn down a claim even if they think it is.

I only have one key for my car. I lost the key along with my house keys whilst on a train one day and they were never handed in (no identifying features and I changed the house locks at it was easy to do just in case). Mine was an Audi and the keys are expensive to replace plus at the time they needed coding and only Audi could do it. Unfortunately for me the little device in the car that controls the programming of the key is kaput and a new key cannot be programmed without it being replaced (£400+). So I decided not to bother, now I only have one key and the master service plastic key.

Make a complaint, make a Data Protection Act request (£10) so you know ALL the reasons they might try and use, get it in their system and then go to FOS (it will take time).
