Rights on Faulty Replacement Goods

Hi,

Just seeking some advice on my rights regarding an iPad that's already been replaced.

In 2010 I bought (in America) an iPad 1 which had the standard Apple 12 month warranty, after I'd had it just over 2yrs the Bluetooth & WiFi stopped working (Sept 2012) so I took it to an Apple Store (in the UK) who advised they could either send it away to be fixed for 'X' amount or replace it with a NEW iPad 1 of the same model (which they had in store, so I could take it away) for the same amount.

Since it was going to cost me the same either way I agreed on the NEW iPad 1. He brought it out in a brown box (not the normal iPad box) but had the plastic cover around it, no marks on it and looked NEW, I asked again if its new and he again said yes its a NEW one. I asked if it had a warranty and he said it comes with a 3 month warranty. So I excepted it, paid the 'X' amount on my Credit Card and put it in my iPad case then when home, put a screen protector on it and set it up and everything was fine, until last Saturday...

A rainbow coloured stripe appeared across the centre of the screen, so I've got an appointment in the next few days at the Apple Store again to see what can be done, however its been just over 4 months since I got it so outside of the 3 month warranty...Do I have any rights under the Sales of Goods Act 1979?

Would this be classed as a replacement or since I paid for it (maybe at a slight discount) still have the full Sale of Goods Acts behind me, with it being less than 6 months old etc.

Just would like to go slighty armed incase they turn around and say tough its out of warranty....All I want is for it to be repaired / replaced Free of Charge, what are the chances of this and my rights for this?

  • If it had been given to you as a freebie replacement for the faulty ipad then you wouldn't have had any rights under the SOGA, however this is not the case.

    You purchased a new unit and the store took your old one in as part exchange and IMO, this entitles you to exactly the same rights as if you paid the full price in cash.

    Many people trade in old cars when buying a new model, and they still have full consumer protection on their purchase and what you did is no different.
