Insurance says I was in a crash... but wasnt?!

I had a letter through from my insurance saying they had a claim that I had crashed into the back of someone else and to send off details etc as it is a fault accident (as I hit the rear of the other car)

Problem is though...

I haven't had or been involved in a car crash or a bump of any kind! In fact at the time of the reported crashed (well date provided) the car had never left my drive way as I stayed in!....

What on earth happens here?!

    Ask them for proof.

    And if you had hit the rear of someone, then surely there would be damage to the front of your car, speed dependant of course. Invite them to inspect it.

    Seems like a case of mistaken identity here.

    Be interested to know how they arrive at the fact you were involved.

  • They said I have to prove I wasn't in the accident when I rang up... no frontal damage isn't a sign as the accident was supposedly a month ago so I could have had repairs since then.

    The guy reported me by registration number and description and claimed I had no ID at the time hence not having my name and that's all they could tell me over the phone...

    Police can't do anything either apart from 'investigate' but again I'm going to run into a dead end as I can't adequately prove I wasn't in the accident...

    ... I'm really not lying here guys, I was at home, I remember specifically as it was an anniversary of a death of my best friend and on that day every year I never ever go out... sorry to be morbid but its the truth.

    If this goes through my premiums are going to rocket up and I'll lose my no claims of 7 years :\

    At least this is definitely wrong - one claim won't mean you lose it all. You should still have 3 years at least at renewal. Check your poliy wording to see what effect a single claim will have on your NCD.

    And if this gets sorted in your favour, consider protecting it at renewal.

    According to UK law, your innocent until proven guilty here.

    The onus therefore is on them to prove you did it, not for you to fess up to something you didn't do.

    Stick to your guns.

    Edit: If you have legal protection, give them a call and tell them what's happening and ask them to intervene.

  • Are there any phonecalls you made from a landline to companies that record calls that you could get details of in order to show you were at home at the supposed time of the accident?

    Tell that to your insurers as well, and start asking what they are going to do to protect you from this fraudulent or erroneous claim

    No. They have to prove you were involved. Not the other way round.

    Questions you need to ask:

    Are there independent witnesses to this alleged incident? Where did the alleged incident occur? Is the location near you? What was the time of the alleged incident?

    Have photos of this alleged incident been provided? Pretty much everyone has at least a camera phone on them (if not a proper camera) so there's little excuse not to take photos at an accident scene. Especially one where they claim the at-fault part had no ID and apparently didn't state their name ;)

    Had a similar claim a few months ago, seems that the witness had misread the reg number, mine ended in RXO and the person involved in the accident RXE. Both the same type and colour of vehicle but the one in the accident was located in the area of registration and the other had moved out of county. Also turned out that the insurer was the same company even though my insurer had a different company name but had farmed my insurance out to a different company.
