Won ESA Lost DLA

Hi,

so I lost my DLA appeal and won my ESA appeal, I'm not bothered about the DLA one if I'm honest, it was my legal reps idea to claim and appeal.

Does anyone have an idea how long it takes for them to sort your money out and backdate it? Also I have a feeling I'm going to get a new form to fill out soon, so what I want to know is, is there a way of avoiding the horrible medicals where they don't even go on your mental illness, just your skeletal structure, I was thinking would a letter where I was assessed by a phycopherapist and a report from my doctor help when I send the new claim form in?

Also, do most people get put into WRAG? I suffer with agoraphobia, and a bit confused as to how they expect me to do WRAG when I have anxiety attacks when I'm outside, plus I cannot walk long distances.

    The money will likely take several weeks at least to come through.
    If they decide they think they may want to appeal the decision - it could be considerably longer.

    The WCA in principle should concentrate on areas you've emphasised as problems on your form.
    If you've said you have problems walking - this may be part of the reason why they looked at skeletal problems.
    (Though to a degree, this will be asked of everyone, it should not take any significant amount of time).
    Avoiding the medicals is in principle possible, if you can supply them enough information so they can assess you without needing to see you.

    Unfortunately, ESA is at best somewhat confused.
    The idea of the WRAG is that it's for people who it's reasonable to help into work in the near term.

    This has been changed so that only people who it's 'reasonable' to help actually get help.

    Ok, thanks very much, the last time I won a tribunal they didn't dispute and it took about 3 weeks to get my ESA adjusted and to get the back date.

    Do they send you a letter if they are appealing the decision??
