No. It means they don't want to pay the FOS charge.
Yes, it means the OP's goodwill redress is less than the fee levied by the Ombudsman referral.

I would of thought that if they are repaying my PPI payments, that would be considered admission of liability?
That's why they specifically include the phrase "with NO admission of liability"

Not sure whether that is the case.

Well, I suppose it's also possible that MBNA want to reduce or maintain the percentage of complaint referrals overturned by FOS.
  • If you don't mind me asking, How long after the FOS deadline did you receive the offer.
I have had mine upheld by the FOS with Feb 5th deadline & not yet heard anything
  • Hi

Original claim sent to FOS in November 2011.

The deadline was 21st November 2012.

FOS wrote on the 31st January 2013 with the offer.

You may be in for a little bit of a wait?

About four months before the deadline letter, they called me for more info..

Thank you for replying - i've typed a little of it out.

I am writing to you about your complaint concerning the payment protection insurance you took out with MBNA.

Following our involvement, MBNA has told us that it would like to make an offer, as a gesture of goodwill and with no admission of liability, to settle your complaint.

It has told us that how much compensation you will receive will be based on the general approach that the FOS takes when we decide that a consumer has been mis-sold PPI. MBNA will calculate the exact amount you will receive if you decide to accept its offer.
.... goes on to state how the offer is calculated (not that they put a figures in ....

Then says : If you would like to accept this offer, and have your compensation calculated in line with the general approach taken by the FOS, you do not need to do anything.

We have until the 14th Feb to decide if we dont want to accept it!
Hi I am in exactly the same waiting period with MBNA - same scenario! I have called MBNA several times to see how much longer I will have to wait to get some figures, but I' m always told they working their way through similar cases ( unhelpful) .

Sorry, I forgot to mention I called FOS about how MBNA work out their 'goodwill ' offer and the advisor said that if I had any concerns then I should call the FOS team and someone will check it for me.

    Good luck
  • I'm in the same boat, with HBOS (on an old AA/Centrica loan). Received the same FOS letter on 6th March telling me that HBOS would be writing soon to tell me details, but it wouldn't be a final figure. Still awaiting the HBOS letter. Did the same happen for you guys, or was it just the FOS letter?

My situation is slightly complicated by the fact that the PPI was on an original loan, which I then rolled into a new loan with the AA about a year after. The 2nd loan was seen to completion about 5 year later. So in my view, whilst the 2nd loan didn't explicitly have PPI, it included the amount of PPI from the original loan. That is why I am eager to see the proposed amount from HBOS to see if it includes interest from the entire history of both loans, or if it is just the first original loan only.

Any thoughts on whether I'm being unrealistic to expect that both loans should be taken into consideration?

    Thanks
    Jon
  • I think there are a few of us around in the same boat waiting..there was another thread going a bit further back by 'Simon the poet' along the same vain, but there were a couple of people who have had there letter from MBNA with the redress amounts so things must be moving.
We must be part of a long queue all just waiting!
I had my letter from FOS at the end of January, stating that MBNA would be making me an offer so I'm guessing it should be any day now. I have to say I'm rather wondering what they are going to offer.
One of the guys on the thread got his letter then promptly recieved his cheque and it was for a lot of money and he wasn't very far behind me which was encouraging. I think it's just a waiting game now..
    Best of luck!! :D
  • Couldn't believe it but got my letter from MBNA today complete with a cheque!!
However a bit weird, no figures at all just a short letter hoping the payment was satisfactory and behind it a cheque for more or less what i was expecting...weird!

I'm not going to hang around, cheque going straight to bank tomorrow no messing! :T

It may be a good idea to hold your horses or at least check with MBNA how they calculated the amount in case you have a tax liability. Although, maybe since it is just a 'goodwill gesture' it is not subject to the normal rules for refunds.

Ok I've confused myself. Hoping to find a similar letter in the post in the next few days.
