warning! - dont send citylink and go on holiday!

I sent an item on 8th Jan via P4D who asked citylink to collect. They did

I went on holiday for 7 days shortly afterwards (not UK), when I returned I had an email from the buyer saying the parcel didn't arrive. Checked the website and sure enough it said collected and en route to depot. Raised with P4D who have spent 10 days saying they have flagged to citylink before telling me today there is nothing they can do as insurance only lasts 7 days (as they state in their terms and condition)

IN OTHERWORDS.....Sellers get 7 days only to report an item as missing, which I find shocking. Citylink aren't even saying its been delivered, just they don't have to refund and wont

Scandalous. I am going to reimburse the buyer £87 he paid

  • If it's in the terms and conditions somewhere and you'll need to demonstrate it's an unfair term (which might be difficult).

    These terms are set by the carrier themselves & we do advise this on our website;

    and from what I can see its a link to a page on their website - NOT the terms and conditions

    so have just written back to them with this

    If you can do this I will accept my mistake in not understanding the terms and conditions, but you can't simply point to some other place on the website and saying senders must be familiar with everything on the entire website

    Agreed but first send a couple of letters (court will want to see proof you tried to resolve amicably).

    If after say, two letters (nb letters not emails, as these are taken more seriously) fill out the small claims court form properly and, before filing it with the court (and paying the fee) send a copy of it to the company and say if you can't resolve amicably you will file within 7 days. That might kick their backsides as that's absolutely an unreasonable term.

    Really it is not a good idea to be selling just before going on holiday however you send the item as it is difficult to deal with any problems when you are on a beach.

    If I am using a carrier I usually tell the customer that it has been sent and should arrive in 24 or 48 hours. They will then get in touch quickly if it doesn't arrive so you can chase it up.
  • the thing is martin the buyer didn't alert me to the fact it hadn't arrived for 11 days!, hence even if I had been in the country unless I had chased him for feedback and/or checking the courier website I wouldn't have known or registered loss

    in future I will make it a task for me to check delivery before relaxing!

    it was 15th day incl weekends, or 11th working day before I contacted p4d

    I will go down the legal route - even if I lose or end up spending more time and money I think on principle if a courier company cant demonstrate delivery they are responsible for losses

    city-link also have a 7 day notification period just had a letter the other day.

    We refer to your claim against the above consignment number, although we are obliged to inform you that your claim is out of time as our trading conditions require written notification of your intent to claim to be made within 7 days from the scheduled delivery date and liability cannot therefore be accepted on this occasion.

    To say I was seething would be an understatement I chased them for 3 days for an update but got the same response a search has been put out they would not even confirm they had lost it. It's almost impossible to get a claim in within 7 days how can they get away with this.

    I have sent parcles for years....guess about 1 a month on average

    few problems.....now 2 citylink parcels lost within 6 weeks (through p4d)

    7 day restriction.....is ridiculous and immoral
