    Ten days later and you still haven't done anything of substance? Then I read the bit that you think every fault should be presented to you in writing! Go on, take him to court, it will be a race to see who starts laughing first, the defendents or the bench! Either take it back and have a face to face, complain properly and stop believing everything that the volunteers in advice shops are giving you, or drop it.

    Morning all...


    so I have spoke to citizens advice and they advised I send him a recorded delivery written letter advising him why Im rejected the car. Reasons being SOGA and because it was sold to me under misrepresentation by omission-he failed to tell me it was sold as spare/repair only. The man I spoke to advised it would be referred to his local trading standards (because I brought it in a different county hence why I cant just drive it back) because he has committed a criminal offence allowing me to drive it off the forecourt.

    Colino - your very negative! things have been moving on slowly in the past week or so just because I didnt post it on here doesnt mean it hasnt happened! and Ive looked online and been advised that dealers have to safety check every car before its being sold. He has either A, Checked the car and not reported any faults to me or B, Relyed on the MOT (Which they are NOT allowed to do) and allowed me to drive away a car which might not be safe. He never informed me it was spare/repair only, they have to make me aware in writing on a document separate to the receipt that I am aware its spare/repair only, its unroadworthy and cannot be drove until all faults are repaired. I was driving a dangerous around for well over a week, I had came off a busy A road when it gave in, if it had happened half a mile back I have stopped in the fast lane and with cars going 60/70 etc MPH somebody would have crashed into me and I could have died, all because some dealer wanted to make a quick buck. I came on here for advice and guidance and you have no offered me ANY!

    oh by debit card. I am in the process of doing a chargeback from my bank

    DO EVERYTHING.. in writing....
    No need for you to take it back, they MUST collect
    Your only issue is proof is down to YOU.... proof depends on value.. so a court doesn't expect you to spend close to the value of the car on a detailed independent report...

    Other than that follow what Tilt said except... you first reject, wait for them to respond (or your deadline expire) BEFORE going to court. Price for court will depend on amount claimed....

    It might be long if it goes this way..... but by sending the correct letters in the right order and doing everything correct they may quickly cave or not!!!!

    If they detect you are desperate for the money they will more likely drag it out and hope you lack stamina to follow through.
