Divorce help

My husband and I have decided to get a divorce, This has been coming a long time but after 15 years its still very painful for me and my head is all over the place. He seems to be being quite sly and taking money from joint account and mortgage etc. I have know idea what to do all I know that this is going to happen and

there is no going back. I anticipate him being awkward, difficult and out for everything he can get. We have 2 children 6 and 8 and i want to protect myself and them.
Is there any practical things i should do whilst documents etc are still in the house? any help as to what to do next?

  • What's he doing about the mortgage? It's not clear.

    Be very careful that the joint bank account doesn't become overdrawn as you'll not be able to close it then and it will remain a joint-liability.

    Thanks for the reply, I will pay the mortgage but it is linked to our savings and he has access via his cash card, he has already transferred all savings to a "secret bank account". the joint acc is already overdrawn, im paying some of my wages accross to keep up a loan repayment which he took out, but i am obviously liable for as is from joint acc. Can i freeze the joint acc despite it being overdrawn?
  • see a solicitior as soon as you can they can attach a thing to the house to stop him selling it or signing it over to someone to stop you getting you half of the house joint account i took myself off this so if he went overdrawn i wasnt responsible silly i know as he emptied the account and i couldnt get half what we had saved he stopped putting his wages into the account and just kept drawing out of it your solicitor will help you all they can not sure about costs as i have heard legal aid is stopping end of march 2013
  • thank you i am going to make an appointment with a solicitor, He was against using solictors but i think its the only sensible thing to do

    If the loan is in his name then you do not have to pay it. It if is in your name or joint names you will.

    If you speak to your bank I think you can arrange so that money can be taken from the joint account with both signatures.
