Travel Insurance Health Declarations

Just used Travelsupermarket.com for travel quote for European area. The best price for a couple aged 62 & 57 was £38 with Flexicoverdirect. Sounded good so proceeded to booking stage. When I checked the Health Declaration it reads( copy from their site)

"No claim arising directly or indirectly from ANY Pre-existing Medical Condition affecting You will be covered.

For the purposes of this insurance, a Pre-existing Medical Condition is considered to be:

* Any past or current Medical Condition that has given rise to symptoms or for which any form of treatment or prescribed medication, medical consultation, investigation or follow-up/check-up has been required or received during the 2 years prior to the commencement of cover under this policy and/or prior to any Trip; and
* Any cardiovascular or circulatory conditions (e.g. heart condition, hypertension, blood clots, raised cholesterol, stroke) that has occurred at any time prior to the commencement of cover under this policy and/or prior to any Trip."

Am I wrong in reading the first part of this clause as a what if:-

a) Cut finger by accident, self treated with shop bought medication, infected on holiday leading to swollen glands/temperature/Doctor or Hospital visit. Claim rejected due to pre holiday treatment.

b) Ear infection 9 month before holiday lead to temporary loss of balance, cleared up with mild antibiotics. On holiday stand up to quickly and lose balance/fall and bang head on swimming pool step support and roll into pool dazed. Rescued by fellow holidaymakers but taken to hospital for check up.
Claim rejected because pre holiday infection may have had an unquantifiable effect on Holiday loss of balance

Sorry but this clause is vague a to me a "getout" for the Company and I for one will avoid them.

ie... if you have had treatment as recommended by your doctor/GP/specialist or have been given prescribed medication as directed by your dr/gp/specialist in the last 2 yrs BEFORE you purchased the policy/started your trip..... ie in the last 2 years before this policy existed or before you started your trip (or aware of a medical condition at the time of taking out this insurance) have you had any treatment, been precibed meds, had any investigationns, surgery etc?

    * Any cardiovascular or circulatory conditions (e.g. heart condition, hypertension, blood clots, raised cholesterol, stroke) that has occurred at any time prior to the commencement of cover under this policy and/or prior to any Trip."

ie are you currently aware or have had of the above heart related conds at the time of purchasing the policy or start of your trip?

If you have been diagnoised with a medical condition you need to declare this to your ins co. Your Dr will inform you of this too. Undeclared medicial conditions would not be covered if they existed at the time of booking the holiday/purchase of ins

    b) Ear infection 9 month before holiday lead to temporary loss of balance, cleared up with mild antibiotics. ear infection - may stop you fromm flying should it happen again and claim rejected if you do not declare this

General rule: if you are aware of an existing medical condition at the time of booking the trip you need to make the ins co aware of this as would be treated as a pemc. Failure to notifiy your company of a known existing medical condition invalidates your insurace. In the event of making a claim, and the insurance company find out the condition already existed through your medical records, your claim will be declined.

Insurance is based on Utmost Good Faith...... ie benefit of the doubt. Knowingly taking out a policy and lying to the insurance company is fraud and fraudulent claims are not paid out.
