I thought they only had to pay if they lost the case with the ombudsmen? If they have to pay even if they are in the right seems very unfair to me - and potentially leaving them open to malicious complaints.0

The theory is that if the ombudsman only got paid if they awarded to the customer then they would have a conflict of interest in ruling in favour of the customer to generate revenue.
Of cause the current system isnt perfect either because as you say it does leave them open to spurious or malicious complaints. Unfortunately powers that be think that is the lesser of two evils and is in part why they also do the discounting for well managed complaints functions etc.
I remember there were two FOS complaints about the hold music being "insensitive" for playing Elvis' Heartbreak Hotel because they'd recently broken up with their partner.0
