    I need some help and advice, my brother suffered a motorcycle accident on 1st January 2013, bike may be a write off, not sure yet.he suffered some nasty injury to his knee and was very badly bruised. woman who knocked him off was from Belgium and decided to cut him up on a roundabout.

    Police were called as was an ambulance and he was carted off to hospital.

    Since then police have said although she was at fault in her country she is allowed to go round the round about in that fashion ..no action is to be taken against her.

    My brother is with Zenith and we are having real difficulty sorting out his claim.
    He has personal accident insurance included in his policy and yet we kept getting calls from Action Direct who wanted to appoint a solicitor to deal with his claim.

    These people sent out a 'courier' with papers for him to sign not explaining anything properly and as soon as they were going out the door said 'I guess I had better give you all this information' and then dissapeard.
    I read all these different clauses on the papaerwork, did not like what I saw particularly the bit about him informing them that he had 'no personal injury cover' which is something he never discussed with them and he does have it, it is clearly stated on his policy.

    So we cancelled with this company, although today I see on the their website that their address is the same as Zenith.

    Yesterday Action Direct (who have pestered him no stop to go ahead with a personal injury claim) phoned and said they can not continue with it because the woman is foreign!

    Yet they told me they work for Zenith!

    They are supposed to be sending out new documents from a new set of solicitors for him to make a claim through!

    I have never come across such incompetence!

    Zenith never answer my e mails, don't return my calls.
    We are at a loss as what to do.

    The bike has now been taken away to be assesed, but I have told my brother I am not sure whether he should bother with this personal injury claim as it is just so frustrating and confusing.

    Zenith don't seem to be one company they seem to 'outsource' and no one seems to have a clue as to what there role is in the company and waht they should be dealing with.

    HELP!

    I'd start your own thread rather than tagging on to an existing one

    Have a read of this thread, as per post #5 significant amounts of cash back are available if you go direct to a PI firm rather than being referred by your insurer.

    The involvement of an overseas driver might put the factory firms off (as you've seen with the Zenith firm) but it really shouldn't be any more difficult than dealing with a UK insurer.

    I also remember there is a PI firm that specialises in bike accidents, don't know if they do cash back but google or another poster will give more detail I'm sure.

    European insurers generally have an agreement with a UK firm for handling claims like yours, I think the MIB maintain a list so if you know who the Belgium woman is insured with then ring the MIB and see if they can tell you who represents them in the UK. Even if you don't know who she is insured with I think the MIB can still help with an overseas claim.
  • If you have a bike claim then you need someone dealing who knows what they are on about

    Look for either White Dalton Solicitors or Fletchers Solicitors, out of the 2 I would use White Dalton. For any Bike repairs and hire of a replacement bike (assuming he can ride) seek out a company called Bikers Legal Defence.
