IVA paid but company refusing to close

I entered an IVA on 4 Jan 07. I have made all my payments and the IVA Companyhave agreed this. However they are refusing to close the IVA and issue aCertificate of Completion.

Back in July 12 they said that this was due to a VAT dispute which is nowsorted. Then in Nov 12 it couldn’t be closed because of PPI that could beclaimed. They say there is a court ruling saying they can refuse to close theIVA.

I have received an annual report for Jan 13 saying all payments have beenmade and all extra money under the 50% rule has been received. But the IVA isstill running, the IVA company are still refusing to close the IVA and I'm notallowed to enter any credit agreements including buying a house, which I needto do (the house becomes an asset and can be taken off me straight away, so theysay).

My questions are; Has anyone else had problems like this? What can I do? Isany of this true about the VAT and PPI? As I've paid all the money under theagreement are they allow to refuse to close the IVA? How will this affect mycredit file, 6yrs have passed but it’s still showing?

  • Mine ended in September. If you contact your IP, they will send the PPI forms out for you to sign (they should have sent them about 6 months before your iva ended). It can take them up to 6 months after receiving the paperwork back from you to complete the iva. I rang them today to push it through and will hopefully know next week what's happening.

    Once they have completed the iva, make sure they update register (you will remain on the insolvency register for 3 months after the closure notification), and send copies of the certificate to the credit reference agencies. Then you can start rebuilding your rating.
