...in my previous thread i stated about overpayment that was owed to me, due to previous employer deducting from earnings and not forwarding on to CSA.

In such a situation, who owes what to whom?

    All Relate to Previous Employer=
The CSA set up Deduction of Earnings order £32 per week
The employer deducted £52 per week
The Employer Failed to Pay CSA for Numerous periods over 8 months
6 Full Months payments in continuation were missed But Deducted from earnings.
Full Statement from CSA stated I owed them £537.11
Full Calculation of Payments Received Against Payments Deducted showed OVERPAYMENT of £2329.46. for periods 2007-2009(when case ended but not closed?)
Csa sent Letter dated 1/1/13 but received 1/2/13 saying " payments were paid onto old account that was closed in 2006"
2/2/13 in convo to CSA they Admitted to NOT Having Recieved these Payments and that it was my Job to Chase company for the said amount.
Am i correct but am sure it is CSA's Responsibility as was on DEO?
  • I'm sorry but shouldn't you be going after the employer? If the csa told the employer to deduct £32 a week and your employer took £52 then that is nothing to do with the csa! It isn't fraud it is theft and what exactly are the csa covering up? They cannot pay back what your employer never sent to them. They probably said there was an over payment based on your wage slips and then discovered they never received more than £32. Either that or I've got the wrong end of the stick because I cannot make any sense of what you have written.
