wrag group appeal won now support group backdated money

ok i rang the dwp yesterday who said that they hadn't got round to sorting out the new entitlement i.e rate of benefit and any arrears if due ? they said it could take 6-8 weeks. so just to update my husband was put in the wrag group in november 12, to which we put in a appeal on the 17 dec 12.. on the 10th Jan 13 letter recieved saying that the decision had been overurned in his favour and he was now in the support group !
my question is if anyone can help is ..
1. will he get any increase in benefit and if so is it from Nov12 ?
2. would he be intitled to any arrears ?if so would that be back dated from Nov 12 also

  • Was your OH a new ESA claimant or a transferee from IB/IS to ESA. If the former - then he will get the revised rate due to Support group claimants from week 14 of the claim - the full amount being £105.05/week (WRAG = £99.15/week) - so it will be the difference £5.90/week from week 14 to the date of the last pay period, with a revision going forward. The 1st 13 weeks are always paid at assessment rate £71/week at present.
    If the latter then you'd get arrears from decision day of transfer if the ESA amount was more than any amount recieved under IB/IS.

    hi he was already on Incapacity Benefit & Income support and after his medical in Nov ' which he was put in the wrag,we appealed and as above on 10th Jan it was overturned and he was put in the Support group, ( it's all so confusing sorry if it sounds daft ..but does that mean he would get backdated to Nov when he was first put in the wrag ?? thanks
  • Yes he should get backdated payments to November if they would have been higher than what he got with IB/IS as there is some transitional protection involved with transferred claims. So if the support payments are say £105.05 a week but he got a higher amount with his previous award - then he should stay on the amount that he had under his previous award until such time as the ESA goes over that amount. DWP do that to stop people being worse off. So it depends on your OH's previous award. Hope that makes sense?
