Insurance - warning and help needed! (a sorry tale)

    Neither of your insurers will be involved.

    You'll need to pursue the car insurers yourself.

    You can find the policy number, name of Insurer and even their telephone number for a small fee from here https://www.askmid.com

    Give them a ring and take it from there.

    Did you sustain any injuries?

    You can claim for your repairs, damaged clothing etc etc

    I was very lucky. Just bruising to my leg and a couple of fingers

    It's worth sending Just Insurance a "Subject Access Report" which will cost you £10.00 and they should send you a copy of all the data they hold on you along with dates they've sent letters.

    If they did not send a renewal letter, you may be able to take action against them

    Don't be afraid to claim for the above injuries, you won't get much money for it (maybe a few hundred) but it all helps
  • You can claim against the other party for your damages and losses, but expect a battle with the other driver's insurers as they will get carried away with arguing a point of ex turpi causa non oritur actio (the law ought not to compensate people who have suffered loss in the course of their own wrongful actions, even where the primary cause is attributable to someone else)

    Your claim should succeed though, but the other side will cause mischief.

    I tend to find the other Insurers do not even realise there's no insurance as they often don't check and as you mention it doesn't really absolve them of being liable.
  • Times are a changing I'm afraid and I get all manner of requests for proof of ownership, insurance, even get requests for proof of ownership of the hire car supplied by the credit hire co (as sometimes a hire company cross-hire in a vehicle from another provider and the insurers get excited when they see a hire car belongs to say Enterprise, yet the hire invoice is from a different company).
