Help needed to dealing with copy agreements

I am new to the forum so please be gentle, and if I make a mistake I apologise in advance.:)
I have two issues that I hope someone will be able to offer their experience.

1.) We have two credit cards in default and we havebeen repaying them a regular amount via Robinson & way for 5 years plus.They will now be paid in 14 months.

We have been trying to reclaim PPI asdue to a pre existing health condition the cover would never have met ourneeds.So we asked for Terms and conditions(also asked for in 2007).

One came back (July 12) ‘please find attached signed copy’.. ofT&c’s, but the copy attached is not a signed copy.:mad:

The second says (July 12) ‘please be advised there is currently noagreement available on the above account. Liability has been establishedpreviously via repayment towards the balance, please see the attachedinformation demonstrating this.’:eek:

We have been and started to pay thesedebts as the company was constantly contacting us and we had to ask them toonly deal with us by letter.

What can we do should we continue topay or is the debt ‘unenforceable’?

I have seen template letters of this,but is this still possible to do something, especially as we also can’t get theinformation to reclaim PPI, but I've got completly confused with the loophole closing case re: credit agreement.

2.) We are being chased by Mackenzie hall for debtnow owned by Cabot Europe. Originally with Citi, then Opus, etc etc etc. Wehave written over 15 letters to them and each time have been passed to theother. Now MHall are threatening ‘doorstep collection’ and Cabot are not responding to our letter neither is MHall. We have also asked for T&C’sfrom them and still not forthcoming.

We have beenpaying regular amounts to all and have annually reviewed this for the last 16years, if it wasn’t for redundancy now for the second time it would all be over.Of course if the redundancy PPI had covered us maybe this would all be a bad very long dream..


Can anyonehelp? I have seen some template letters from 2007 and I’m worried they don’tapply now.

    They don't, you know you owe the money and your actions by paying it confirm it. You can't get out of it as easy now.
    As for the PPI if it was missold to you then that should be pretty straightforward. However the PPI may only go back 6 years so if the claim is much further back than that you may be stuck but in some cases it's still claimable. Have a good read through this page http://www.moneysavingexpert.com/reclaim/ppi-loan-insurance and click any links that are relevant to you.

    From what i've read on the link we won't be able to reclaim, but still doesn't seem right that mis-sold PPI as husband has type 1 diabetes and we have paid and we only wanted the T&c's/ copy agreement to check and be able to claim.

    Is there any way of ie rules where we can write to them and ask for PPI back without info request?

    They dont need to send the original signed copy, a reconstituted copy along with the current T&C's is enough.

    Why do you want the T&C's for the Mhall debt?
  • Same reason PPI, as all on old credit cards which would not have covered husbands health condition.

    Do what wealdroam says for your PPI questions, and post on the Debt Free Wannabe board for your debt question - you definitely need separate threads otherwise the responses will get hopelessly confused.
