summons to court

hi guys,

need a little help.

just before xmas my patner got a letter saying she was caught speeding by a static camera (35 in a 30) the letter was dated june 2012 she recieved it dec 2012.
She wasnt driving it was myself, so i sent the letter off with my details explaining it was me who was driving and we have only just recieved the letter.

In Jan i got a letter back saying i have to deal with the court now as it has gone to them.

Today she have recieved a summons 1. speeding 35 in a 30 and 2. not supplying details of the driver.

i admit i was speeding but not the 2nd one on failure to supply details as we didnt get the letter until Dec.

If i would of got the letter i would of dealt with it, i am a honest person.

Any ideas what i need to do to deal with this?

    are we missing some facts here?
    - who is the registered keeper?
    - does the V5C have the correct address on it?
    Have you moved address since June last year?

    when you say 'letter was dated june 2012 she received it dec 2012.' do you mean the date of the alleged offence was in June 2012, or the letter was actually dated June 2012? Do you have the envelope, and is the postmark legible?

  • hi thanks for quick responce,

    we have now sold the car but she was the keeper at the time and i was driving

    we have not moved and the V5 had the correct address

    i have no issue in paying the fine and the points just feel hard done by with the faily to supply details bit

    we dont have the envelope the offence was in may and the letter was dated june

    so where's the letter been?
    bottom of wife's handbag?
    how can you prove you only received it in December?
    at the mo I don't see you have any defence; however it's worth talking to the postmaster, see if they have any cases of missing or lost mail / mailbags in your area being found and delivered in December from your local delivery office.

  • David i dont know where the letter was if i was a post master i might know a little more and no not at the bottom of my partners handbag but thanks

    PO do have quantities of mail go missing and turn up much later, sometimes whole mailbags full. I was serious in suggesting to talk to the Postmaster at your local delivery office, if they own up to such an incident at roughly the right time (just before your letter arrived) then you have a good defence, mitigating circumstance at least.

    and obviously check if the date on the letter is within 14 days of the date of the offence
