Ebay purchase too small. Seller won't accept return. SNAD on PP or eBay??

Hi all
Quick SNAD question - have done a google search on this and found conflicting info.
Long story short do you action a SNAD through eBay or PayPal if you buy a pair of shoes that don't fit?
I found a post on MSE similar to my case and want to action a SNAD but am unsure whether this is done through eBay or PayPal or both?
I have the link to the case but MSE won't post it!! Not quite sure how to deal with that
Background:
I bought a pair of Kurt Geiger shoes from an eBay private seller 10 days ago. When they arrived they were waaaaay too small for me and when I compared them to other Kurt Geiger shoes I own, they were minute. I could barely get my feet into them.
I took them to my local Kurt Geiger concession in Debenhams and the manager said they looked like fakes, but couldn't confirm and said Geiger head office couldn't help as they were sold via a private sale.
I contacted the seller, (who also stiffed me on postage - they charged me £4.99 then sent it through franked mail at their workplace). They said the shoes were authentic and would not offer a refund.
I've got a 100 per cent feedback and don't want to jeopardise it. I don't want any hassle or to upset the seller but don't want to be stuck with a pair of shoes that don't fit and I can't sell on as they may be fake
Any advice most welcome
Thanks loads
Sarah

You won't be jeopardising your feedback as a seller cannot leave a buyer anything other then positive feedback or none at all. If you believe they are fake and the seller cannot prove otherwise then open a case, ignore further commuications with the seller and make sure if you have to post it back you do so tracked.0

Depending on which site you open the case with (paypal or ebay) you either have to prove it's fake, or seller has to prove it's genuine. Not sure which one round it is, so I would wait for someone else to advise before you open the case
I think once you do win you get told to destroy them if they are fake, so you shouldn't even have return postage to worry about.0 -
Hi there
Firstly, what size were they advertised as in the listing and do they have a size on the actual shoe? If there's a discrepancy there you've got your SNAD case.
Secondly, if the above doesn't work for whatever reason, do they accept returns?
Thirdly, where is their address? Some unscrupulous sellers have been known to list a UK address but are actually operating from China in which case the shoes may well be fake.
If you want to find out whether they are fake I wouldn't bother with a concession but go to a proper standalone branch and/or ring Kurt Geiger head office. I've dealt with their customer service before and they're very helpful plus I think they'd want to be alerted that fakes are being sold. The only issue with this is if head office asked you to send them in that might take a while and there'll be a clock ticking on sending them back to the seller.0 -
Just open a snad in paypal as it's quicker do not mention anything about them being fake you'll just cause yourself a whole lot of hassle. Just state they are not as described as they are the wrong size, don't mention specifics theres no need.
Escalate it to a claim asap and paypal will eventually ask you to return the shoes tracked-once tracking updates you will get your refund.
I wouldn't trust recorded delivery it doesn't seem to ever track these days, you can use myhermes, collect+ ect for around £3.30 (hermes) you'll get tracking to the door.0 -
You mean wrongly sized0

I've got a branded skirt, well known brand that is labelled a 16 but is clearly a 10.Could it be a wrongly sized factory second?0

What size shoe did it say in the listing?

A concession in Debenhams is just lowly paid, uninterested and untrained staff selling 'designer names' to the public. You will never get any staff member agreeing to state that an item is fake.
I contacted the seller, (who also stiffed me on postage - they charged me £4.99 then sent it through franked mail at their workplace). They said the shoes were authentic and would not offer a refund.
How do you know they 'stiffed' you on postage, perhaps the 'workplace mail' is their company, how do you know how much they actually paid?
You did agree to the p&p price when bidding/buying, dont moan about it now.

But they might not be fake.

If it did not say a size, then more fool you!
If it did say a size, and the fit is marginal, then i can understand the seller AND buyer both being annoyed.
If it did say a size and the fit difference is huge then i can quite understand your feelings.Lose is to not win......Loose is not tight......get it right!0 -
Just cancel it dude?0

For everyone who posted constructive advice, thanks so much and have a lovely weekend. I really appreciate your input.0

Hi I forgot to mention that at my old workplace I used to post through our postroom, which franked mail, but we would still be charged the correct posting price by the postroom. I'm sure most offices have the same policy so I just wanted to say to everyone that franked mail doesn't always mean the buyer hasn't paid.
By the way, OP, no worries for the constructive advice and you can always hit the thanks button for those you feel responded helpfully!0
