Seeking a solicitor to take action against another solicitor for negligence

    Don't rely on the Law Society being of much help! I note in earlier posts you mention they have been involved. Their complaints procedures are based on set timescales, so you shouldn't be waiting more than a couple of weeks between steps. However, despite what they say, the system is flawed.

    As previously mentioned, you can move between Solicitors and your new Solicitor will request the file. At that point, your old Solicitor may present a bill. If you have a dispute with it, there are timescales to make them aware of any issues. In my case, I didn't pay my first Solicitor for almost 2 years after I moved to a new Solicitor. ( Law Society and Lay Observer were involved )
    When you get a Bill, go over it in detail. I found over £800 of mistakes in mine!


    I think you need to get a Solicitor involved asap. Most Solicitors have a free initial consultation. You could even go to several Solicitors and see whose response you like best. For your part, keep records of everything ( dates, times of phone calls - keep notes of any conversations and try to get things in writing, perhaps in email form ). If you can, start now and write down everything that has happened, in detail. I cannot stress this enough.

    Once you retain a Solicitor, they must give you written details of the potential cost and details of what they are going to do for you. Any mention of cost should include VAT. They must keep you updated on costs on a regular basis.
    That said, I have never actually met anyone who has been provided this, without asking! However, I can testify to the necessity of making sure they do. Did your Solicitor provide this ?

    I would be interested to hear if you find a Solicitor to take a case against another. My second Solicitor, took my business to a conclusion but would not take a case against the first Solicitor.
