Paid for Special Next Day delivery but didn't get item?

I won an auction on Sunday night and paid straight away via PayPal.
Postage was almost £9 which included Special Next Day delivery so I expected it to be posted on Monday, arrive on Tuesday. It didn't.
I'm hoping it will turn up today, a day late. I'm a bit annoyed I paid for something I didn't get. If it doesn't turn up today either then that's a bigger problem but have I got any rights to say anything about it not turning up yesterday? Seller didn't actually say when she would post it, just that it would be Special Next Day Delivery (1 working day).

If the seller didn't say when she was posting it I wouldn't unduly worry. Special delivery is required for items over £34 in value, it doesn't necessarily mean it will be sent any quicker, just that it will arrive the day after it is sent.
Contact your seller, ask her when it will be sent and ask for a tracking number. Isn't that terribly misleading?
I think it's wrong that Next Day Delivery can be advertised if that's not what's going to happen and technically the seller can wait a week to send it out.
Perhaps seasoned eBayers would know this but your average Joe would think it did what it says on the tin. It doesn't!

The important word here is 'delivery' it says nothing about nect day despatch so the statement is not misleading at all.
As I mentioned in my first post special delivery is a requirement for items over £34, it has nothing to do with the speed of despatch. There is a box that the seller can fill out to say what their average despatch time is, not everyone does that but it might show up on the auction if you look around the box where the postage methods are shown. If the seller completes that to say they despatch in 1 working day, then they would have to have despatched it on Monday, possibly Tuesday at a pinch.
Or, lastly, if the item was sold as a 'get your item fast' item...in that case desaptch is required, and not optional, within 1 working day. they have 7 days to send the item out so i wouldnt start panicking yet, unless they said how many days on the item to dispatch.

No, they didn't say anything about dispatch unfortunately so I'll email (and very politely) ask when it's likely to be sent out.
I realise what you are saying will be technically correct, I still just think eBay should have a printed statement on the postage section of the auction page to say that Next Day may well not be next day, or sellers should make that clear.
It's not surprising that there is so much bad feeling with eBay/buyers/sellers sometimes. Simple things like this through poor communication/lack of understanding are the very things that cause issues that lead to negs being given. If this kind of thing was clearer then I wouldn't have had the expectations I did and I wouldn't have had to post here asking for help.
It may well say something along these lines in amongst the reams of help pages, but I don't eBay very often and I find it really difficult trying to find things out as there is so much to wade through. A simple statement on the auction page would help.0 -
The trouble is people simply dont bother to read the t&c when they sign upto to ebay, just sign up. Then only find out about the terms when they buy something, and dont get it straight away.
90% of sellers will usually have on there listing about delivery times, something like 2-3 days or post only on certain days.Mansion TV. Avoid at all cost's :j0 -
I imagine there is a risk of muppets making a purchase at 9pm on a Sunday and then expecting their item on the Monday morning - 'next day delivery'

I agree with you neil, I will hold my hand up and say I certainly didn't read everything through when I registered. I'd go so far as to say not many people do. That's why I think a simple auction page set statement to cover something as basic as delivery points would be a siimple solution.
I've just gone to the help pages and looked in the A-Z for 'delivery','post', 'packing', Special', 'Next Day', 'Policy: Delivery' and there's nothing relevant or no help topic at all.
Now I'm not saying there is nothing on eBay about this, just that I can't find it. Yet another reason why a simple basic point about postage should be made on the auction page to advise inexperienced eBayers such as myself. It would take up only a few character spaces and it would go a long way to deflect any possible misunderstanding.
My seller made no mention of when she would post at all, only that it would be Next Day Delivery. Regardless of the eBay policies/rules or whatever, as I said before, ordinary Joe would make the natural assumption that Next Day Delivery meant just that. (Within reason F_fay)

From the sellers perspective;
I've got an item listed ending this Saturday evening. I'm charging for postage as Special Delivery (next day).
With the bank holiday I won't be able to post until Tuesday so the earliest the winning bidder will get it will be Wednesday.
Is my listing therefore misleading?0 -
I posted a phone special delivery on Monday,and when doing so, was asked at the post office if the reason for SD was speed or value as they need to mark it down. I did specify in the auction that if the phone was paid for sunday night then they would receive it on tuesday, and I always state in normal auctions that items will be posted day after cleared payment - a lot of ppl don't mention when they will post though and on those I just assume it will be within 7 days regardless of the delivery method.0
