    If this was a Thomas Cook flight, you should post in the Thomas Cook thread - I suspect there will be a large number of similar posts

    May I endorse that comment. The amount time that you have spent in compiling this information is amazing.

    Given the lengths that the airlines are taking to evade their obligations, e.g. the two year "rule" when they know full well that this is wrong, I wonder whether there is some organisation who can discipline them in the same way that banks and others were disciplined over the PPI scandal which included the banks deliberately misleading customers about their rights.

    I am about to commence Court proceedings against Thomson and will post the details in that forum

  • How and where can I check if an airlines explaination of exceptional circs is accurate? i've been told by Alitalia that part of my delay was due to ATC, which does not tie up with what we were told in the lounge on the day.

    I've looked on the NATS site but there doesnt seem to be any historic info there - anyone got other suggestions?

    There is no definitive list of what constitutes extraordinary circumstances - you need to read the regulation in conjunction with the Wallentin judgement (links in the FAQs) that explains the principles for this. Generally speaking, technical failures in an aircraft are not ECs.
  • Hello there,
    I just wanted to say thank you for the information here about claiming for delayed flights.
    Our Ryanair flight was delayed 10 hours from Tenerife to Bristol, Sunday 3rd of March.
    After reading up on what I was entitled to, I wrote to Ryanair and sent it by Fax and Signed for Post, telling them I wanted a reply within 14 days.

    I got an automatic reply in a day, I told them I wouldn't accept that as a reply, within a week I received an email saying a Cheque would be written to the amount of 400 euros each for the four of us.

    After 10 days of nothing, I sent a fax reminding them, with attached letter they sent. They told me it was delayed, but on the way.

    A cheque arrived within 5 days.

    Very happy and it paid for the holiday, nearly.

    Thanks again and good luck everyone else. If I can help further, just ask. For the first time in my life, I did something right. My wife is over the moon.

    You can't. There is no website to my knowledge that does this. The only way to be certain about the cause is to bring a court case and demand the evidence. Being told "on the day" is just hearsay.

    But you could look for other flights leaving about the same time (eg on airstats). If they were not delayed, it would be more challenging for the airline to justify why your plane was. How late was the delay?

    It was a 56 min delay that led to us missing our connection and incurring a delay of over 3 hrs in reaching our final destination...

    What will a court case cost me? Just the small claims fee?
