Faulty Goods

Hi all, I bought a silverline digital caliper a year ago from a shop with a 3 year warranty. Used it infrequently but then noticed it stopped working the terminal under the battery was not actually soldered where it should have been. Tried to return it to the shop for another but owner had retired and the shop gone. So sent it to silverline with note for repair or replace please. Today I got a cheap plastic one in the post from them (it cost 1/3 of the original). When I spoke to them today they said that the caliper I had returned was discontinued and the cheap plastic one was all they do. I asked about a refund and would return the one sent but they said it was not their problem take it or leave it. Surely I have more rights than this..........anyone ?

    More right...? Why would you think so. They've replaced it...might not be the same one but at least they've delt with your complaint.

    How much did it cost? Did you pay with a credit card/
    Who runs the warranty?
    Answer those 3 questions and we can help you.

    Who provided the Warranty? The original vendor is responsible, but if no more, then the manufacturer can be minded to assist, and I appears they have done so. The fact it is not the model you bought, or cheaper is immaterial they offered a goodwill gesture, and there it ends if you choose not to accept.

    Your rights expire when the dealer departs, and this has always been the case. As to why it stopped working, a common answer is it may have been abused, but from your description, someone handy with a soldering iron could get you up and running with ease.

    Not so in my opinion.The rights OP has falls under the warranty or if paid for by a credit card and cost more than £100 S75 of the CCA kicks in where the credit card has joint liability for the defect of the product.
    If the product is no longer available and a substitute has been rejected IMO OP can ask for a refund from the credit card.
    However we still await a response from OP.

    But the seller no longer exists.

    Surely you are not suggesting using the sale of goods act against the manufacturer, are you?

    Way less than £100. The "plastic" one is in fact fibre composite and seems to be middle of the range. The price of these calipers have dropped dramatically over recent years. Silverline, which is a mid price tool brand, selling a 150mm caliper for £50 ?
