A major problem is occuring, whereby people are being awarded and winning employment tribunal cases and are not getting their money. In my case my ex employer can close a company down and then set up another one, without paying staff.i have been fighting for 2 years, and was awarded alot of money. I just taken my ex employer back to court to be questioned about his finances, so i could apply for an attachment of earnings against him.be warned this is an absolute farce. He told the court he is self employed, he doesnt have show any proof and therefore i cannot go for an attachment of earnings against him because of that, however if he was salaried i can. What i total joke, as he could be earning £5000 a month self employed but you cant do anything, yet he could be salaried at £1000 a month and you have a case. This needs to be addressed and the law changed as this person is setting up companies, not paying staff, then putting them into liquidation and then starting up fresh again.any help or advice on this would be very grateful. My award judgement was against him not the company, but the law seems to favour him and it costing me money to persue him ,when he left me high and dry with nothing:(

Try the High Court Sheriffs, these guys seem to be able to get blood out of a stone, as the award is against him personally then any of his assets can be seized for payment of the debt.
There is a series running on BBC 1, The Sheriffs Are Coming (last episode today but can be watched on BBC iPlayer.).
