dla tribunal advice please

i have my sons dla tribunal soon, he has ADHD and need constant care during the night, he was getting middle rate care until he turned 16 then i had to re apply, ive since been taken off it and am going to tribunal soon, i have a letter from doctors regarding his night time need's which is what he was getting the care rate for, ive also got welfare rights to represent me at the tribunal, is there any more i can do? also if and if we win the tribunal can i claim back the tax credits i should have received and carers allowance? any help will be appreciated xxx

    My first thought is... who is your representative and shouldn't they be advising on the positive implications of winning the tribunal?

    If you win the appeal normally the linked benefits can be reinstated and backdated but different rules apply to different benefits so you need to check this with your representative.

  • thanks for that, its welfare rights who is representing me, didn't want to think too much about winning my appeal as i will be disappointed if i don't, i have been told that if i win the dla will be back paid until July when it stopped but was unsure of the other benefits i should have been receiving since then, thanks for your help.
