iPod repair - no ipod, no repair, no refund!

Hi, everyone - looking for some advice about what I can do here.
I arranged and paid via Paypal for a repair to my ipod touch on 11th December, and posted the ipod off. Received a couple of emails, one before Christmas and one after NY, saying that the chap was waiting for a part, and then another saying that fixing the original problem hadn't fixed the ipod, so he was ordering a new board for it.
Last week I rang and spoke to the chap; he apologised and said he hadn't been able to fix it after all, but would return it the following day and issue a full refund, less return postage. Really annoyingly I believed him - and that was Day 45 of Paypal's dispute-claiming time limit.
Now I'm out of pocket - AND this company still has my iPod. I've emailed Paypal to ask them if there's anything they can do, but I'm doubtful. My next step will be to try to get my bank to make a chargeback. But what should I do about the iPod? It's broken - but it's still mine.

Just to add: according to the website and yell.com, this is a legit shop in Cumbria. I just don't know what to do as my last two emails have gone unanswered and when I tried to ring earlier today there was no response. :-/0

Send him a 'letter before action' (search on MSE or Google) giving him 7/14 days to return the ipod or you'll take it to the small claims court.0
