ESA (Contribution based)

Can I ask for some advice please ?
My wife is waiting on a claim for above. She worked p/t for (14hrs p/w) from 1.4.11 to 31.12.12 .She paid no tax(under the personal allowance threshold) and no NI contributions.
Will she get NI Credits for her period of work which covers the 2 preceding tax years ?
This would seem to be crucial for the claim to be agreed (apart from the medical issues).
Many thanks

If she hasn't paid NI contributions recently then she won't be entitled to contribution based ESA.

For a claim made now, the important periods are tax years 10/11 and 11/12.
Work done since April 12 does not count at all, so she has only worked in one tax year.
    (It will next January).
However - if she was earning below the Lower Earning Limit - which it sounds like she was - she will not have any NI conts for the period.

Thanks-the rejection letter came today even though my wife meets the NI credit threshold, it's the 2011/10 year that's the problem.
Does anyone know how I go about getting the NI credits officially acknowledged ?

Does she have her P60 as that will show her income and deductions.

Was she working in that tax year?
  • Sorry for delay-first of all thanks for your help-yes but for one day only ( she worked 4.4.2011 to 31.12.12).
Any ideas on how to get the NI credits-she could presumably make another ESA (conts)claim on 6.4.13, but I am told that this gets even more complicated as there is a tax year, and a benefits year-help I am drowning in a Kafkaesque nightmare !
