TUPE or not TUPE??

Hi, Me again.

We have now had our TUPE meeting with our new 'employers'.

It was quite obvious from the off that they are not in the least interested in us as staff, didn't ask about our experience or anything. Just talked AT us, told us that everything about the way we currently work will be changing (and I mean everything!)

They have put their staff into a process whereby they have to re-apply for their jobs and will allocate all the positions just days after we enter their employment. We are entitled (under our current contracts) to a period of consultation and they have suggested we forgo that in order to partake in their selection process now rather than after TUPE as otherwaise all the positions will be filled!

Not sure that this is strictly legal and I am certainly not forgoing any of my rights!

Another quick question..................

If ROLE1 is where I work the majority of my hours and ROLE2 where I work the minority, could the company taking over the business where I work in ROLE2 take over my TUPE rights if everyone was in agreement??
