Hi, I bought a TV and an extended warranty, the TV has developed a fault and no longer works.
The company it was bought from have gone bust, they went into receivership and were taken over by a similarly named company. I have phoned this company in order to use the extended warranty with them, but they have informed me they only have "limited access" to the previous company's order information, and although they can see I did indeed purchase an extended warranty, they are unable to give me the reference no or any other details.
At this point I should point out the extended warranty comes from a third party company, and I was asked to phone them directly, but unfortunately they have no reference to my warranty purchase.
I was just wondering if there is anything I can do. I have thought about writing to the credit card company, since it was purchased on a credit card, and see if I can claim the money for the TV back from them stating section 75. I'm not sure that applies however, since the company went into receivership.
Would be grateful of any advice!
Thanks.

I take it they must have some of your details to allow them to tie it upto.I was just wondering if there is anything I can do. The company no longer trading has no bearing on S75. But the fact you have access to a 3rd party warranty does.Never ASSUME anything its makes a>>> A55 of U & ME <<<0 -
Yes, consider a Section 75 claim.
You give us no idea of timescales, so maybe a refund of the purchase price is not appropriate, but Section 75 of the Consumer Credit Act 1974 makes the Credit Card Company equally responsible for performance of the contract.
Read MSE's Section 75 Refunds article for more detail.
In there you will read that S75 is particularly useful if the seller no longer exists.0 -
Surely the warranty provider, can find your details quite easily by giving them your name address postcode and tel no.
Any co worth their salt can do this in seconds.
You didn't go in straight away all guns blazing for a refund did you? That IMO would be the only way they have said they cannot help you, they have put the barricades up in defence.0 -

Just a guess, but it is possible the defunct retailer never passed details (or money) to the warranty company.rustyboy21 wrote: »Surely the warranty provider, can find your details quite easily by giving them your name address postcode and tel no.0 -

Wow. Thanks for all the responses, Brilliant!
I'm going to try the warranty company again, I didnt go in all guns blazing so to speak, they couldnt find any reference to my name/address etc. I suspect wealdroam might be right in guessing the money wasnt passed to the company.
If I have no success with that I'll try the s75 claim.
Will let you know how it goes, thanks again.0
