Misrepresentation of Mail Order Goods

Looking for some advice as I purchased a liquid cooler from the a large mail order company that claimed compatibility with my computer motherboard, but when the goods arrived it was obvious without opening the goods that it was not compatible.

The box still remains shrink-wrapped and I have been asked to return it at my own cost for a refund, as they are quoting "Distance Selling Directive (SI2334/2000) which allows a 'cooling off' period for customers" to allow me to deliver it.

Since they misrepresented the goods as being compatible do I have any rights to demand that they pick up the goods at their expense?

Also, considering I paid for expedited delivery, I would assume that I cannot claim a refund on delivery, since this "service" wasn't faulty.

    If it's not compatible, then tell them you are returning under the Sales of Goods Act, as the goods were misdescribed. This makes them liable for the cost of return.
    One important thing to remember is that when you get to the end of this sentence, you'll realise it's just my sig.
  • And for a full refund of all costs you incurred, including the premium delivery.

    How do you know it's not compatible, these kits have different adapters to suit a few different motherboards, I would be interested to know how you know it wont fit just by looking at the box.
  • Bris, I am pretty savvy when it comes to IT. I researched this and found that there were two models, the one retailer advertised was a compatible model, which is why I went with them.

    But when the package arrived on front of the box it stated all compatible motherboards, and the LGA 775 was not one of them. I then did a look up on the product and Antec changed the cooler backplate without adding LGA775 fixing holes. I checked online and found people with issues with the v4 cooler, which is different from the one advertised. On the back of the box just next to the barcode it says v4.

    Therefore v4 is not compatible. In all aspects they should thank me for not opening it, otherwise it would need to be sold as an open box/customer return :)

    Oh, and I took a web archive of their page, just in case they tried to change it as evidence.

    Thanks everyone for your advice, I will contact BT and have a good old this is my rights, you need to honour it, this was not my fault and you misrepresented the items for sale.
