    You may have to look at the definition of "Non-advanced education" where some benefits are allowed or "Advanced education" where benefits can be denied.

    There's nothing in case law to state that OP's OH is estranged, so therefore it may be difficult to claim at this stage anyway.

    You need to seek advice from a specialist advisor, as whilst I'm experienced in dealing with HB claims (the forms, not the processing), this is a situation that would be judged on a case-by-case basis, which I can't do without looking at all the circumstances. I do not feel comfortable doing this on an open forum for obvious reasons, one of them being that I do not want my professional opinion to be wrong.

    I've had a quick flick through the HB rules for students as I'm typing this, and can't find anything to this effect, even though I am aware of rules being in existence for this. Please also be aware that I represent an area with no universities, and therefore this may impact my opinion further.

    It may be worth filling out the form and seeing what happens, but ensure that you have a backup plan just incase. Ask to speak with someone from the council (employed by the council), or the Cllr with responsibility for housing (legally independent, and have signed declarations to this effect.) There may be more than one, there are two in our council, which is relatively small.

    Have you heard back from Shelter, and when you have, please let us know, however on the tenancy agreement, I will not let a valuable asset to someone under 18 years of age; please bear this in mind as another potential barrier.

    There is a lady who deals with the processing, and I don't think she's seen this thread yet, so it may be worth waiting for her, as once the form is in, whilst I often am asked to clarify, I don't make the decisions personally.

    OP what you propose is really not worth all the hassle trust me. Quite a few years ago now me and my partner did something similar she wanted to go to uni and wanted me her disabled partner to go with her. NOBODY could tell us what we could claim because they had no clue how this complex area worked so we had no choice but to use savings and just do it and claim after finding somewhere to live.

    Finding a place was really tough as well not surprising really what landlord wants a disabled person who cannot work and a student whose course requirements meant they could not work either. We had to pay upfront and have a guarantor to get a tenancy at all.

    Other major problems kept surfacing during the first 18 months as the DWP, council and decision makers kept changing their minds on our entitlement. It was sooo stressful and it was only down to a CAB lawyer things got sorted out.

    Now your situation is a bit different and given the hassle and mess are you sure that you want the headache this will cause you both at this stage of your relationship? i honestly don't see why you cant just get student digs and leave your partner to stay with parents and go finish her A levels before joining you in a year?

    We have been applying for part time work, I never said I didn't want to work, but the problem is my hours change week by week so I can't specify shift times. I am effectively doing a double degree and on days with lab work I too don't get back until 6-7 when I can start to do my work. I can't work odd hours here and there either as the bus is £6 return in the week to get there which reduces a two hour evening shift to £2 an hour. Consequently I am looking into survey sites as this seems the only option.

    Have a look at freelance sites, such as Elance and PPH.

    Whilst the pay can be low, if you can find something related to your course, this experience may help you when you finish.

    As a student, she can only claim benefits if she is estranged. The fact that you think that she can claim is what has led people to assume that she is estranged.
