ESA do I have to repay if I fail it

I have been refused my ESA following my medical in Nov 12 but I am appealing it through the CAB. I will get the basic ESA amount whilst awaiting my appeal to be heard but if I fail the appeal will I have to repay all the money I receive whilst awaiting the appeal to be heard?

    No, they will not. People can in theory spend years applying and appealing, all the time receiving the assessment rate, and never passing a WCA.

    No Stanley, however long it takes your appeal to be heard you won't have to pay anything back.
  • thank you all so much for your kind responses! I was really worried they will demand it all back from me and to be honest it is such a worrying time! I don't think it is right to create such unnecessary stress to people who are already having difficulties

    The only exception is if you've made a fraudulent application.
    For example, gotten a fictitious medical report made up, to claim when you're not entitled.
