Purchased faulty game, refused refund

    The shop is wrong, plain and simple. They've agreed there's a fault and should offer a refund. A credit note, unless that was the method of original payment, does not constitute a refund. The SOGA applies equally to the sale of used goods as it does new.

It's just a case of bullying thinking because they hold the money they hold the cards, and the fact that a 5ft 3" woman isn't exactly the most intimidating type of customer (although it took two clerks and a supervisor to tell her to leave with what they would give her!)

    I am going to go back in a few hours, am I entitled to correct them and obtain a refund?

    You can go with her and argue her case, but as you did not purchase the goods, then you have no rights.

  • Additionally a credit note has already been accepted - you should have taken the disc to return to fight your cause another day.

    Still, I think you will still have a battle on your hands, despite being 100% in the right.

    A letter to head office would probably yield a better response. At the end of the day, you cannot force the obstinate manager to refund despite being in the right, so that would only leave legal action - a lot of hassle for what is probably a relatively small amount.
    One important thing to remember is that when you get to the end of this sentence, you'll realise it's just my sig.
