Child moving away, reduced contact

If a child is moved hundreds of miles away from their father by the PWC, therefore inhibiting the time spent with the father - is this taken into account?
Father is paying for flights and chaperone services for him to come home as often as possible since the move & despite paying agreed sum of maintenance consistently the PWC has decided to involve the CSA. Prior to the move the child spent 40% of time with the NRP but obviously this much reduced.
TIA

Was it court ordered access...??? If it was, then there could very well be a problem, if it was agreed and contracted in anyway then there could be a problem, if it was a verbal agreement, then you are stuck with what it is unfortunately...
As far as the CSA goes, there is a formula they use that takes into account milage and cost but it is not normally anything worth trying to claim... But phone then and notify them of a variation application for travel, and see where it gets you...
If it is not through the CSA then it will be down to personal choice, if it is travel out of the country again the same...
More details would be helpful to give a good answer...0 -
no, all priror/current arrangements are verbal - child has moved from one end of the uk to the other.... flights are the only real option for travel. child has been away for almost a year & flights have been booked for every school holiday at significant cost
everything has been almost always been amicable and the sudden announcement that the csa are being contacted is a double whammy as the child is desperately missed. if the nrp has to find more money it's likely to number of visits will be reduced even more, when previously he was with nrp 40%0 -
i have read that if there is considerable distance then csa is reduced, u have to look into it though x0

That is really not good news... And unfortunately not an awful lot you can do apart from try to get the costs reduced...!!! And that means a variation for travel...
This is one of those situations where if you had had contracted or ordered contact, then the move would not of happened. As an application would of had to be made to the court for it to be changed and as it would not be in the interest of the child to be moved so far from one parent it is unlikely it would be granted...
Shame and i feel for you...
See if you can contact your MP or Citizens Advice to find out what you can do or if there are plans to change how this works to bring some fairness to the NRP0 -
Rather important question, but is the father actually paying CM at 15% of his net paythe moment?
If so he wont have nuch to worry about. He can put a variation in for travel costs but his liability wont be reduced to much.0 -
well, 15% ... if he has a 40% share of contact would of meant about only 4/7ths payment... (or paying 40 quid instead of 70 quid... for simpler terms...)
if this is now under 52 days... hee has to pay the full 70 quid... considered fair?
and... variations have to be "agreed" by the PWC... from what i gather...0 -
thanks all
so nrp is likely to see less of his child, but have to pay more which will then inhibit any future contact further - not sure how this benefits the child.
shame we didn't realise the importance of the contact order -but as i mentioned it was all amicable previously so never thought it was needed. child originally resided in scotland before moving to england, not sure if makes a difference..
will def consider contacting our MP or CAB - that for the suggestion
