Faulty Goods Second Time Round

Good morning
I ordered a pair of frames and lenses from an overseas company. They broke just within the warranty time, and the firm were excellent in sending a replacement. Six months in, the second frames are now faulty and I cannot wear them. When I contacted the company they said the one year warranty was from the date I ordered the first pair of frames and lenses so I am not covered. Is this the case? I ordered with a credit card initially- is there anything I can do with this?
Many thanks
Alison

the warranty period starts with the first item you buy, if you have any replacements under warranty then the warranty period does not reset.

The supplier is right, under the warranty replacement you aren't covered.

Had it been a UK company you could have gone down the SOGA route, but as they are overseas you are out of luck there I am afraid.
  • Thanks - that's really useful.....

I suppose my credit card guarantee for faulty goods is no good either?

I am now stuck wearing glasses with an old prescription as my new ones are unwearable as the paint has worn off the frames and causing an allergic reaction to my skin bringing it out in a weeping sore - sorry too much information.....

    So disappointing...

    Many thanks again

If the goods were over £100 wouldn't the OP be covered by S75 ?

Hi - could you not take the specs to a shop in the UK and have them put the prescriptive lenses in some new frames.
I know this will cost you for the new frames but at least you will be able to wear them. Several years ago to cut costs I got some NHS type frames. They were actually really nice and people remarked how nice they looked.
    They were very cheap.
Or.... maybe if you have a nice opticians they will put your lenses into old frames you have already have. It's worth asking. :)

On what grounds? How could the goods be deemed faulty when to the CC its an 18 month old purchase?

The issue is the coating on the frame has come off, they would need to be assessed to see if this is a manufacturing fault - these are eye glasses, something you use daily so its a high wear and tear item.

On the grounds that the credit card company are equally responsible for the performance of the contract.

You said yourself that it would be difficult getting the overseas supplier to do anything under SoGA...

...so perhaps the OP should speak to their card company about 'going down the SOGA route'.

AlisonMargaret, have a read of MSE's Section 75 Refunds article.
