Advice on Faulty exchange

Hi, i just wanted an answer to the problem i have & not sure where i stand as things are.

I bought an electrical item from Maplin using my credit card in June 2011 which developed a fault in May 2012 with just 2 weeks left before the 12 month guarantee ended so i took the item back to Maplin with the original till receipt. The staff were able to test for the fault in the shop without sending it away, they confirmed & agreed there was a fault so gave me a brand new replacement there and then. the staff wrote on the receipt that a new exchange took place at the given date.....great result, i was very happy with this, however the same or similar fault has now occured again on the exchanged item earlier today, Saturday 26th January 2013......what i'm asking here is, does the replacement item still have a 12 month warranty from when it was exchanged even though i had just 2 weeks left on the original purchase?

Legally, they don't have to - but some retailers (like PC World) do.

probably unlikely in most cases the warranty runs from the date of the original purchase.

if you were given a brand new receipt then yes, but as they wrote on the original then very unlikely

    best to ask them really
  • why keep saying "item" over and over why not just say what it is?

  • Thanks to all that replied. It's seems the "item" is not guaranteed:(

Paul Carter, would the answer / outcome be any different by stating that the so called "item" was an amplifier?? Your comment was totally invalid.

Yes, it might be - the item in question is completely relevant. If it is something that cost a couple of quid, then you'd struggle to assert your rights under SOGA. However if it cost a couple of hundred quid, then you would expect it to last longer than a year and a half and therefore you might have rights under SOGA .
