    You can get legal advice through your Union. Go with them; they then can work for all employees together.

  • I am in the same boat iv been on nightshift for 7 yrs i was on a 39 hour contract working 10 hour shifts but a few months ago i changed to a 16 hour contract working 2 8 hour shifts now they are not being upfront about whats happend with the holiday pay but its been underpaid to nightshift coz they work 10 hour shifts so coz am now on 8 hour shifts they say im not on the list and am not due anything as of the 1st of jan this yr my contract is 8 hour shifts i really need sum more info if there is anyone out there who knows whats going on any advice would be great

    Sorry cant understand your post, what is your problem? are they not giving you holidays?

  • I'm so glad i found this thread, to see that im not the only one facing this position.

    like most of you here i used to do 10hr shifts (I did these shifts for 7 years) but about a year ago i stepped down from being a team leader and with this i had to return to do 8hrs.

    So i heard about this payoff and instantly thought that i would be entitled to it. But another immediate thought was that i have not been doing 10hr shifts for over a year and they are only backdating it 3years.
    I have few arguments about it because they claim they are unsure how long the system has been corrupt so how many years have i been diddled for.
    Do you think i could argue that i should get the full pay out as a "goodwill" gesture as i did them shifts for 7yr. and constantly stayed late and never got paid for that extra work.

    Another point to argue is that the payoff will be worked out on few different factors; difference in old holiday hrs calculation to how its calculated now (i think its about 15hrs); Your CURRENT pay rate(inc premium,loc pay,skills payment, etc);current contracted hrs,length of service up to 3 years. (apart from if you have not done enough i.e if you have done 2yr 2month they will ROUND UP to closest 6months so you would get more than you should at 2.5yrs)
    My argument with this is that my current pay scale is not what i was earning when i was doing 10hr shifts. so even less payout,but someone could get more just because they are rounding up.

    But none of this matters as they believe i am not entitled to this payout. After HR saying this i said you need to go back and ask again and more details why i am not getting it. so HR are waiting to hear from "REWARD" a group who deal with it at head office.

    I know what the answer will be. And starting to feel the stress of having to do this fighting for it.

    I will be pursuing this as much as possible as i honestly believe i am entitled to it. I will be contacting the union and hope many other people do too.

    Have the others effected by this seen the printout that managers are supposed to huddle to relevant colleges??
  • basically there is no update as I've seen this post for afew days now and only just replied. judging by the original post date and today date they are stalling us to just say no.then they send letters out on 20th and it is paid 22nd and will probably say "you missed the date".

    And the company wonders why their "talkback" questionaire gets a result of "no i would not recommend working for"
