    Why have you listed your daughter's DLA as an expense? You're (at least) £569 per month better off than you think you are!!!

    Hi,

    In my view if you were to both go BR, there would be no IPA for the one completely on benefits and the one working could expect (whether I agree that is right or wrong) an IPA of the amount of their earned income £266 per month.

    You would then have to decide whether to agree the IPA or not.

    Why have you listed your daughter's DLA as an expense? You're (at least) £569 per month better off than you think you are!!!
    I think DLA is for additional expenses you incur when you have a disability such as for continence aids, preparing food, sensory stimulation etc. It's to enhance that child's life so perhaps they have expenses for the child.

    I'm not sure what could cost that much per month (car, perhaps?).

    I'm not sure either but I don't have that experience and not sure if you've got a disabled child or adult in your home.
    The car is paid for out of the mobility allowance by the looks of it. Day centres for even one session of 3 hrs cost my friend £18 for her mum which I thought was a bit steep but the adult services everywhere in my area are all now outsourced and private companies run them for a profit I think.

    DLA money is the child's money and is not taken into account as a parental income.
    That makes sense that it can't be treated as parental income for the IVA to use to calculate how much they can pay back. It's to enhance the life of the child as I mentioned earlier.

    The way it works is that DLA has to be declared and listed on the SOA, but is not counted as income. You then put it on the other side as an expense to negate it in the total. It's crazy but it's what you have to do to balance the SOA.
    DLA is an allowance, not a benefit, so doesn't count for most financial assessments. There are arguments for and against this position but that's the way it is re BR.

    I like what you are saying, and your words apply to most situations but the out of step Insolvency Service don't agree with you........

    In the context of this chapter "state benefits” refers to all forms of income supplement and support provided by central or local government including, but not limited to: income support, job seekers allowance, disability living allowances, incapacity benefit, industrial injuries disablement, council tax benefit, housing benefit, state retirement benefit (state pension), child benefit and all forms of tax credit (child, working and pension).
